The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 24 and 287(3) of the Town and Country Planning Act 1971(1) and section 148(2) of the Local Government, Planning and Land Act 1980(2) and of all other powers enabling him in that behalf, hereby makes the following Order:

Application, citation and commencement

1.-(1) This Order shall apply to the Wolverhampton urban development area.

(2) This Order may be cited as the Town and Country Planning (Wolverhampton Urban Development Area) Special Development Order 1988 and shall come into force on 31st August 1988.

Interpretation

2. In this Order, "Wolverhampton urban development area" means the area designated as an urban development area by the Wolverhampton Urban Development Area Order 1988(3).

Permitted development

3.-(1) The Town and Country Planning (Black Country Urban Development Area) Special Development Order 1987(4) shall have effect to permit development within the Wolverhampton urban development area in the circumstances in which, and to the same extent as, and subject to the same limitations, conditions and restrictions as, it is permitted by that order in the area designated as an urban development area by the Black Country Development Corporation (Area and Constitution) Order 1987(5), and, accordingly, the first mentioned order shall have effect subject to the modifications mentioned in paragraph (2).

(2) The modifications mentioned in paragraph (1) are-

(i)in article 1(1), the insertion at the end of the words "and the Wolverhampton urban development area";

(ii)in article 2, the substitution for the definition of "the development area" of-

""the development area" means the areas designated as urban development areas by the Black Country Development Corporation (Area and Constitution) Order 1987 and the Wolverhampton Urban Development Area Order 1988;"; and

(iii)in article 6(2)(f), the substitution of the words "the development area" for "their area".

Explanatory Note

(This note is not part of the Order)

This Order is a special development order applying to land within the Wolverhampton urban development area. The functions of an urban development corporation for that area are performed by the Black Country Development Corporation by virtue of the Wolverhampton Urban Development Area Order 1988.

Under section 148(1) of the Local Government, Planning and Land Act 1980 the Secretary of State, after consultation with the appropriate local planning authority and any other local authority which appears to him to be concerned, may approve proposals submitted to him by an urban development corporation for the development of land within its area. Section 148(2) of that Act provides that a special development order may grant permission for any development of land in accordance with proposals so approved. This Order grants permission for the carrying out of any development in accordance with such proposals, within the Wolverhampton urban development area, in the same circumstances and subject to the same limitations and conditions as it is permitted in the Black Country urban development area.

Copies of schemes submitted by the Black Country Development Corporation and approved by the Secretary of State will be available for inspection by the public at the offices of the development corporation.
