The Rickmansworth Water Company (Repeal of Local Enactments) Order 1988

Whereas the local enactments specified in the Schedule to this Order appear to the Secretary of State for the Environment to be inconsistent with section 23(1) of, and abstraction licences granted under, the Water Resources Act 1963(1);

Now, therefore, the Secretary of State in exercise of powers conferred by sections 1(2)(c)(2), 133(1) and 135(1)(3) of the Water Resources Act 1963 and now vested in him(4), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.-(1) This Order may be cited as the Rickmansworth Water Company (Repeal of Local Enactments) Order 1988 and shall come into force on the 10th November 1988.

(2) The Rickmansworth Water Acts and Orders 1884 to 1986 and this Order may be cited together as the Rickmansworth Water Acts and Orders 1884 to 1988.

Repeal of local enactments

2. The enactments specified in column (1) of the Schedule to this Order (which enable the Rickmansworth Water Company to abstract defined quantities of water by means of certain pumping stations) are hereby repealed to the extent specified in column (2) thereof.

Explanatory Note

(This note is not part of the Order)

This Order repeals local enactments enabling the Rickmansworth Water Company to abstract water by means of their pumping stations at Amersham, Batchworth, Berkhamsted, Blackford, Bulstrode, Chalfont St. Giles, Chartridge, Chorleywood, Deep Mill, Gerrards Cross, Hughenden, Hunton Bridge, Iver, Mill End, Springwell, Stockers, Uxbridge, West Drayton, West Hyde and Western Avenue.

The Company's right to abstract water from these stations is governed by licences granted by the Thames Water Authority under sections 33 and 34 of the Water Resources Act 1963; and in some cases the Authority has varied the licences so as to provide for abstraction of amounts of water which differ from those permitted by the local enactments. This Order accordingly repeals those provisions which are inconsistent with the 1963 Act or the provisions of the current licences.
