The Merchant Shipping (Fees) (Amendment) Regulations 1988

The Secretary of State for Transport, in exercise of powers conferred on him by section 33(2) of the Merchant Shipping (Safety Convention) Act 1949(1) and by section 13(1) and (7) of, and paragraph 2(i) of Schedule 2 to, the Merchant Shipping Act 1988(2), and of all other powers enabling him in that behalf, and with the approval of the Treasury, hereby makes the following Regulations:

1. These Regulations may be cited as the Merchant Shipping (Fees) (Amendment) Regulations 1988 and shall come into force on 1st December 1988.

2. The Schedule to the Merchant Shipping (Fees) Regulations 1988(3) shall be amended as follows:-

In Part V, the words in brackets in the sub-heading shall be amended to read:

"(excluding fishing vessels within the meaning of Part II of the Merchant Shipping Act 1988)".

3. After Part V, a new Part VA shall be inserted as follows:-

"Part VAREGISTRATION ETC OF FISHING VESSELSFees for Registration and Transfer of Fishing Vessels, Registration of Mortgages thereon and other Related Matters and for Inspection of the Register under Part II of the Merchant Shipping Act 1988.

1. In this Part:-

"counter service" means any service performed for an applicant attending in person at a Local Office or at the office where the Register is kept;

"Local Office" has the same meaning as in the Merchant Shipping (Registration of Fishing Vessels) Regulations 1988(4).

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Merchant Shipping (Fees) Regulations 1988 by inserting a Part prescribing fees payable in respect of registration of fishing vessels in the new register established under Part II of the Merchant Shipping Act 1988
