The Social Security (Unemployment, Sickness and Invalidity Benefit) Amendment (No. 3) Regulations 1988

The Secretary of State for Social Security, in exercise of powers conferred by section 5(2) and (3) of the Social Security (No. 2) Act 1980(1) and of all other powers enabling him in that behalf, by this instrument which contains only provisions consequential upon, and is made before the end of a period of 12 months from the commencement of, section 7 of the Social Security Act 1988(2) hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Social Security (Unemployment, Sickness and Invalidity Benefit) Amendment (No. 3) Regulations 1988 and shall come into force on 1st January 1989.

Amendment of regulations 25 and 27 of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983

2. In regulations 25(1) and 27 of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983(3) (disregard of pension payments on account of redundancy and calculation of weekly amounts of certain pension payments) for the words "the age of 60" there shall be substituted in each of those regulations the words "the age of 55".

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the provisions, contained in the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983, for the disregard of certain pension payments and for the calculation of the weekly amount of pension payments made other than weekly.

The amendments are consequential upon the reduction from 60 to 55 of the age at which unemployment benefit falls to be abated by an occupational pension.

These Regulations contain only provisions consequential on, and are made before the end of a period of 12 months from the commencement of, section 7 of the Social Security Act 1988 and are accordingly exempt by section 61(5) of the Social Security Act 1986 from reference to the Social Security Advisory Committee and have not been so referred.
