The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 1, 7(1), 8(1), 15(4), 29(1) and (2), 72, 86(1) and 88(2) of the Animal Health Act 1981(1) and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Zoonoses Order 1988 and shall come into force on 22nd December 1988.
2. In this Order -
"the Act" means the Animal Health Act 1981;
"animals" means bovine animals, sheep, goats, deer and all other ruminating animals;
"the Ministers" means the Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly.
3.-(1) Bovine spongiform encephalopathy, being a disease of animals which, in the opinion of the Ministers, constitutes a risk within the meaning of section 29 of the Act, is hereby designated for the purposes of that section.
(2) The provisions of the Act listed in the Schedule to this Order shall apply in relation to bovine spongiform encephalopathy with a view to reducing the risk to human health from that disease.684
4. In article 2 of the Bovine Spongiform Encephalopathy Order 1988(2) the words "in its application to this Order" shall be omitted.

Section 29 of the Animal Health Act 1981 ("the Act") empowers Ministers, with a view to reducing the risk to human health from any disease of animals, to make an order designating any such disease which, in their opinion, constitutes such a risk and applying any provision of the Act to that disease.
The Order designates bovine spongiform encephalopathy for the purposes of section 29 (article 3(1)) and applies certain provisions of the Act to bovine spongiform encephalopathy with a view to reducing any risk to human health from that disease (article 3(2) and the Schedule).
The Order also amends article 2 of the Bovine Spongiform Encephalopathy Order 1988 so that the definition of "disease" as extended by that article will now apply for all the purposes of the Act without being restricted to the purposes of that Order (article 4).
1981 c. 22; section 86(1) contains a definition of "the Ministers" relevant to the exercise of the statutory powers under which this Order is made.
