HIGHWAYS, ENGLAND AND WALES

The Chester-Bangor Trunk Road (A55) (Travellers' Inn Improvement) Order 1988

Made

5th February 1988

Coming into force

16th March 1988

The Secretary of State for Wales makes this Order in exercise of powers conferred by sections 10, 12 and 41 of the Highways Act 1980(1) and of all other enabling powers:-

1. The new highways which the Secretary of State proposes to construct along the routes described in Schedule 1 to this Order shall become trunk roads as from the date when this Order comes into force.

2. The centre lines of the new trunk roads are indicated by heavy black lines on the deposited plan.

3. The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that-

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure, or prescription, the Secretary of State shall be under no duty to maintain the part in question, until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.

4. The length of trunk road described in Schedule 2 to this Order and shown by broad striped hatching on the deposited plan shall cease to be a trunk road and shall be classified as an unclassified road as from the date on which the Secretary of State notifies the County Council of Clwyd that the new trunk roads are open for through traffic.

5. In this Order:-

(1) All measurements of distance are measured along the route of the relevant highway.

(i) (2) (i) "the plan"

means the plan numbered HA10/2-WO58 marked "The Chester-Bangor Trunk Road (A55) (Travellers' Inn Improvement) Order 1988."

(ii) "the new trunk roads"

means the highways mentioned in article 1 of this Order and "a new trunk road" means one of those highways.

(iii) "the trunk road"

means the Chester-Bangor Trunk Road (A55).

6. This Order shall come into force on 16th March 1988 and may be cited as the Chester-Bangor Trunk Road (A55) (Travellers' Inn Improvement) Order 1988.

SCHEDULE 1ROUTES OF THE NEW TRUNK ROADS

The Routes of the new trunk roads are routes at Travellers' Inn in the County of Clwyd as follows:-

1. A route about 370 metres in length, starting at a point on the trunk road marked "A' on the plan 195 metres west of the centre of the junction beween the trunk road and the Class III road to Dyserth at Glan Llyn and terminating at a point, on the trunk road marked "B' on the plan, 195 metres east of the centre of the aforesaid junction.

2. A route about 330 metres in length starting at a point on the trunk road marked "C' on the plan 225 metres west of the centre of the junction between the trunk road and the Class III road to Caerwys at Coed Bach and terminating at a point on the trunk road marked "D' on the plan 110 metres east of the centre of the aforesaid junction.

3. A route about 825 metres in length, starting at a point on the trunk road marked "E' on the plan 400 metres west of the centre of the junction between the trunk road and the Class III road from Tremeirchion to Mostyn at Travellers' Inn and terminating at a point on the trunk road marked "F' on the plan 440 metres east of the centre of the aforesaid junction.

SCHEDULE 2LENGTH OF TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of trunk road ceasing to be a trunk road is that length of the trunk road about 713 metres in length commencing at a point west of the entrance to Cae Rhys, 348 metres west of the centre of the junction between the trunk road and the Class III road from Tremeirchion to Mostyn at Travellers' Inn and terminating at a point adjacent to the western boundary of "Tea Pot Cafe" and OS Parcel 5765, 365 metres east of the centre of the aforesaid junction.
