The Welsh Water Authority (Ashgrove Treatment Works and Heronbridge to Sealand Pipeline and Associated Pipelines) Order 1988

Coming into force

19th February 1988

The Secretary of State for the Environment as respects England, and the Secretary of State for Wales as respects Wales, on the application of the Welsh Water Authority, being statutory water undertakers(1), and in exercise of powers conferred by sections 23, 32(1) and 59(1)(2) of the Water Act 1945(3) and now vested in them(4), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Welsh Water Authority (Ashgrove Treatment Works and Heronbridge to Sealand Pipeline and Associated Pipelines) Order 1988 and shall come into force on the 19th February 1988.

(2) This Order and The Welsh Water Authority Orders 1976 to 1987 may be cited together as the Welsh Water Authority Orders 1976 to 1988.

(3) In this Order-

"the Authority" means the Welsh Water Authority;

"the deposited plan" means the plan prepared in triplicate signed by an Under Secretary in the Department of the Environment and an Assistant Secretary in the Welsh Office and marked "Plan referred to in the Welsh Water Authority (Ashgrove Treatment Works and Heronbridge to Sealand Pipeline and Associated Pipelines) Order 1988" one copy of which is deposited and available for inspection at the offices of the Authority at Cambrian Way, Brecon, one at the offices of the North West Water Authority at Dawson House, Great Sankey, Warrington and one at the Welsh Office, Cathays Park, Cardiff;

"the Third Schedule" means the Third Schedule to the Water Act 1945;

"the undertaking" means the water undertaking of the Authority as for the time being authorised by any enactment.

Power to acquire, continue and maintain works

2.-(1) The Authority may acquire by agreement from the North West Water Authority and thereafter continue and maintain-

(a)the Ashgrove Treatment Works edged red on the deposited plan;

(b)the mains pipes and apparatus the approximate lines and positions of which are shown by blue and green lines on the deposited plan.

Works to form part of the undertaking

3. The said treatment works, mains pipes and apparatus when acquired by the Authority shall for all purposes form part of the undertaking.

Application of provision of the Third Schedule

4. For the purposes of this Order section 94(5) of the Third Schedule (which requires copies of the special Act to be kept by undertakers in their office and to be deposited with certain officers) shall apply to the undertaking and is hereby incorporated with this Order.
