The Secretary of State for Social Services, in exercise of the powers conferred upon him by section 35(5) of and Schedule 20 to the Social Security Act 1975(1), and of all other powers enabling him in that behalf, by this instrument, which contains regulations which relate only to matters which in accordance with section 140 of the Act of 1975 have been referred to the Attendance Allowance Board(2), makes the following Regulations:
1. These Regulations may be cited as the Social Security (Attendance Allowance) Amendment Regulations 1988 and shall come into force on 7th April 1988.
2. In regulation 6(2) of the Social Security (Attendance Allowance) (No. 2) Regulations 1975(3)-
(a)in sub-paragraph (d), for the words"in both places where that word appears" there shall be substituted the words"in section 35(1)(a)(ii)", and
(b)after sub-paragraph (d) there shall be inserted the following sub-paragraph-
"(e)after the words"watching over him" there were inserted the words"(these requirements being substantially in excess of the requirements normally placed upon another person by a child of the same age and sex).""

These Regulations amend the Social Security (Attendance Allowance) (No. 2) Regulations 1975 in so far as they relate to children. They provide that the second of the night-time conditions for entitlement to an attendance allowance, as amended by section 1 of the Social Security Act 1988 (c. 7), is to apply in relation to children only where the requirements of the child are substantially in excess of those normally required by a child of the same age and sex.
