SOCIAL SECURITY

The Social Security Act 1986 (Commencement No. 9) Order 1988

21st March 1988

The Secretary of State for Social Services, in exercise of the powers conferred on him by section 88(1) of the Social Security Act 1986(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.-(1) This Order may be cited as the Social Security Act 1986 (Commencement No. 9) Order 1988.

(2) In this Order, unless the context otherwise requires, references to sections and Schedules are references to sections of and Schedules to the Social Security Act 1986.

Appointed days

2. The day appointed for the coming into force of the provisions of the Social Security Act 1986 which are specified in the Schedule to this Order is 11th April 1988.

Revocations

3. In the Social Security Act 1986 (Commencement No. 7) Order 1987(2), the commencement in the Schedule to that Order of the following provisions of the Social Security Act 1986 are revoked, that is to say-

(a)Schedule 3, paragraph 11, and section 39 in so far as it relates to that paragraph;

(b)the repeals in Schedule 11, and section 86(2) so far as it relates to those repeals, of the following provisions-

(i)in the Social Security Act 1975(3), Schedule 4, Part V, paragraphs 13 and 15, and in Schedule 20, the definitions of"The deceased" and"Industrial death benefit";

(ii)in the Social Security (Consequential Provisions) Act 1975(4), Schedule 3, paragraph 18;

(iii)in the Pneumoconiosis etc. (Workers' Compensation) Act 1979(5), section 2(3), the words"industrial death benefit under section 76 of the Social Security Act 1975, or".

The following repeals in Schedule 11 and section 86(2) in so far as it relates to those repeals-

in section 117, subsection (4) and in subsection (5), paragraph (a) and the word"and" immediately following it.

Industrial death benefit

Explanatory Note

(This note is not part of the Order)

Article 2 brings into force on 11th April 1988 the provisions of paragraphs 8 and 10 of Schedule 3 to the Social Security Act 1986 and consequential repeals.

Article 3 revokes the commencement in the Social Security Act 1986 (Commencement No. 7) Order 1987 of paragraph 11 of Schedule 3 to the Social Security Act 1986 (which relates to widower's death benefit) and of specified repeals in Schedule 11 to that Act which relate or refer to industrial death benefit.
