The Offices, Shops and Railway Premises Act 1963 (Commencement No. 3) Order 1989

The Secretary of State, in exercise of the powers conferred by section 91(2) of the Offices, Shops and Railway Premises Act 1963 (1) ("the 1963 Act") and now vested in him (2), and of all other powers enabling him in that behalf, hereby makes the following Order:-�

1. This Order may be cited as the Offices, Shops and Railway Premises Act 1963 (Commencement No. 3) Order 1989.

2. Section 91(4) of, and Schedule 2 to, the 1963 Act shall come into force on 16th January 1990 in so far as they relate to the repeal of section 37 of the Shops Act 1950 (3) and that repeal is not already in force.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 16th January 1990, in relation to premises which are in a covered market place, the repeal of section 37 of the Shops Act 1950 (c. 28) (seats for female shop workers) provided for by section 91(4) of, and Schedule 2 to, the Offices, Shops and Railway Premises Act 1963 (c. 41). The repeal of section 37 came into force for all other purposes on 1st August 1964 by virtue of article 1 of, and Part III of Schedule 1 to, the Offices, Shops and Railway Premises Act 1963 (Commencement No. 1) Order 1964 (S.I. 1964/191 (C.3)).

The effect of this order is to remove as from 16th January 1990 the requirement for seats to be provided for the use of female shop assistants in covered market places.
