The A423 North of Oxford-�South of Coventry Trunk Road (Kidlington to East Adderbury) De-Trunking Order 1989

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1. The length of the trunk road described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road and shall be classified as a principal road as from the date on which the Secretary of State notifies the County Council of Oxfordshire that the new motorway is open for through traffic.

2. In this Order:-�

(i)"principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;

(ii)"the deposited plan" means the plan numbered HA 10/2 WMRO (L) IX marked "The A423 North of Oxford-�South of Coventry Trunk Road (Kidlington to East Adderbury) De-Trunking Order 1989," signed by authority of the Secretary of State and deposited at the Department of Transport Romney House, 43 Marsham Street, London SW1P 3PY;

(iii)"the trunk road" means the North of Oxford-�South of Coventry Trunk Road (A423);

(iv)"the new motorway" means the motorway to be provided by the Secretary of State in pursuance of the M40 London-�Oxford-�Birmingham Motorway (Umberslade to Warwick Section) and Connecting Roads Scheme 1976(3), and the M40 London-�Oxford-�Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No.1) Scheme 1984(4), (No.2) Scheme 1985(5) and (Supplementary) Scheme 1985(6).

3. This Order shall come into force on 18th December 1989 and may be cited as the A423 North of Oxford-�South of Coventry Trunk Road (Kidlington to East Adderbury) De-Trunking Order 1989.

THE SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length from the junction of the A423 with the A41 at East Adderbury south of Banbury to the junction of the A423 with the A43 south of Kidlington, a distance of 24.9 km measured along the length, all in the County of Oxfordshire.
