The Secretary of State, in exercise of powers conferred by section 58(1) of the Merchant Shipping Act 1970(1) and now vested in him(2) and of all other powers enabling him in that behalf, hereby makes the following Rules:-�

Commencement and interpretation

1. These Rules may be cited as the Merchant Shipping (Section 52 Inquiries) Rules (Amendment) Rules 1989 and shall come into force on 20th February 1989.

2. The Merchant Shipping (Section 52 Inquiries) Rules 1982(3) shall be amended by omitting rule 5(2).

Explanatory Note

(This note is not part of the Rules)

These Rules amend the Merchant Shipping (Section 52 Inquiries) Rules 1982, which lay down rules for the conduct of inquiries into the fitness or conduct of officers, by omitting rule 5(2), which laid down qualifications for persons hearing inquiries.
