The National Health Service (Recognition of health service bodies) (Scotland) Order 1990

The Secretary of State, in exercise of the powers conferred on him by sections 88(1)(e) and 105(7) of the National Health Service (Scotland) Act 1978(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the National Health Service (Recognition of health service bodies) (Scotland) Order 1990 and shall come into force on 1st March 1990.

(2) In this Order "the Act" means the National Health Service (Scotland) Act 1978.

Recognition of health service bodies

2. The Secretary of State hereby specifies each Area Audit Committee established by each Health Board(2) in Scotland as being a body recognised by him to have been formed for the purposes of performing a function connected with the provision of services under the Act.

Explanatory Note

(This note is not part of the Order)

This Order, which comes into force on 1st March 1990, specifies as bodies recognised by the Secretary of State as having been formed for the purpose of performing a function connected with the provision of services under the National Health Service (Scotland) Act 1978, Area Audit Committees established by the Health Boards in Scotland.

The Order is made under section 88(1) of the National Health Service (Scotland) Act 1978 which empowers the Secretary of State to pay to members of certain bodies, including any such recognised under the section, travelling and other allowances as may be defined by the Secretary of State with the approval of the Minister for the Civil Service.

Each of the fifteen Health Boards in Scotland has established an Area Audit Committee to assist with the process of medical audit of the health services provided in its areas.

1978 c. 29; section 105, which contains provisions relevant to the making of orders by statutory instrument, has been amended by the Health Services Act 1980 (c. 53), Schedule 6, paragraph 5(1) and Schedule 7, and by the Health and Social Services and Social Security Adjudications Act 1983 (c. 41), Schedule 9.

Health Boards are established under the National Health Service (Scotland) Act 1978, section 2 for the areas determined by the National Health Service (Determination of Areas of Health Boards) (Scotland) Order 1974 (S.I. 1974/266), and constituted by the National Health Service (Constitution of Health Boards) (Scotland) Order 1974 (S.I. 1974/267) and exercise functions conferred by section 2(1) of the Act and by the National Health Service (Functions of Health Boards) (Scotland) Order 1983 (S.I. 1983/1027, as amended by S.I. 1989/446).
