The A43 Oxford-Market Deeping Trunk Road (South West Kettering to Weekley) Detrunking Order 1990

Coming into force

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1. The lengths of the trunk road described in the schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road and shall be classified as classified road as from the date on which the Secretary of State notifies the County Council of Northamptonshire that the new trunk roads are open for through traffic.

2. In this Order-

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) "classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

(ii)"the deposited plan" means the plan folio numbered HA10/2E/273 marked "The A43 Oxford-Market Deeping Trunk Road (South West Kettering to Weekley) Detrunking Order 1990", containing a key plan and one plan marked "Scheme Plan" and signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(iii)"the new trunk roads" mean the trunk roads to be provided by the Secretary of State in pursuance of the A43 Oxford-Market Deeping Trunk Road (Kettering Northern Bypass) Order 1987(3) along the route prescribed by Schedule 1 to that Order; and

(iv)"the trunk road" means the Oxford-Market Deeping Trunk Road (A43).

3. This Order shall come into force on 24th January 1991 and may be cited as the A43 Oxford-Market Deeping Trunk Road (South West Kettering to Weekley) Detrunking Order 1990.

THE SCHEDULELENGTHS OF THE TRUNK ROAD CEASING TO BE TRUNK ROAD

The lengths of the trunk road ceasing to be trunk road are in the County of Northamptonshire, and consist of all or part of the roads known locally as Northampton Road, St Marys Road, Windmill Avenue and Stamford Road, totalling about 55 kilometres, being-

(a)from a point 655 metres southwest of its junction with Westhill Drive, generally northeastwards to its junction with Sheep Street, Kettering, a distance of about 16 kilometres, and

(b)from its junction with London Road, Kettering, northeastwards to a point 375 metres northeast of its junction with Weekley Wood Lane, Weekley, a distance of about 39 kilometres.
