The Secretary of State for Transport, in exercise of the powers conferred on him by article 3 of the Merchant Shipping (Prevention and Control of Pollution) Order 1987(1) and after consulting with the persons referred to in section 22(2) of the Merchant Shipping Act 1979(2) in exercise of the powers conferred on him by section 21(1)(a) and (b), (3), (5) and (6) and section 22(1) of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Merchant Shipping (IBC Code) (Amendment) Regulations 1990 and shall come into force on 1st January 1991.
2. The Merchant Shipping (IBC Code) Regulations 1987(3) are hereby amended as follows:
(i)in regulation 1(3)-
(a)amend the definition of "1974 SOLAS Convention" by adding at the end "and as further amended by amendments adopted on 21st April and 28th October 1988 and 11th April 1983 by Maritime Safety Committee of the International Maritime Organization";
(b)in the definition of "BCH Code" replace "(1986 Edition)" by "(1990 Edition)";
(c)in the definition of "Control of Pollution by Noxious Liquid Substances Regulations" after "the Merchant Shipping (Control of Pollution by Noxious Liquid Substances in Bulk) Regulations 1987(4)" add "as amended";
(d)in the definition of "IBC Code" replace "(1986 Edition)" by "(1990 Edition)";
(e)in the definition of "MARPOL 1973/8" add "and as further amended by amendments adopted on 17th March 1989 by the Marine Environment Protection Committee of the International Maritime Organization";
(ii)in regulation 11 after "the Merchant Shipping (IBC Code) Regulations 1987" add "as amended".

These Regulations amend the Merchant Shipping (IBC Code) Regulations 1987.
They bring into effect amendments which have been adopted by the Maritime Safety Committee and the Marine Environment Protection Committee of the International Maritime Organization. The adopted amendments rationalise and add to the lists of substances appended to Annex II of MARPOL 73/78 with some changes of categorisation. Additional substances have been added to Chapters 17 and 18 of the IBC Code largely from pollution aspects and there has been some change in existing categorisation and some editorial amendment. A 1990 edition of the IBC Code has been produced.
