The Merchant Shipping (Load Lines) (Exemption) (Amendment) Order 1990

The Secretary of State for Transport, in exercise of the powers conferred by section 18(2) of the Merchant Shipping (Load Lines) Act 1967(1) and now vested in him(2) hereby makes the following Order:

1. This Order may be cited as the Merchant Shipping (Load Lines) (Exemption) (Amendment) Order 1990 and shall come into force on 28th March 1990.

2. The Merchant Shipping (Load Lines) (Exemption) Order 1968(3) shall be amended as follows-

(i)in article 1(1)(d) for "section 38 of the Pilotage Act 1913(4)" there shall be substituted "section 6 of the Pilotage Act 1987";

(ii)article 1(1)(f) shall be deleted; and

(iii)the definition of "sailing ship" in article 2(1) shall be deleted.

Explanatory Note

(This note is not part of the Order)

This Order amends the Merchant Shipping (Load Lines) (Exemption) Order 1968 to remove the exemption for sailing ships which, if they were under 80 tons register engaged solely in the coasting trade, were exempt from the requirements of the Merchant Shipping (Load Lines) Act 1967 while not carrying cargo. Sailing ships which come within one of the other classes in the Exemption Order will still be exempt (as will pleasure yachts which are excluded from the application of the Act).

The Order also updates the reference to pilot boats.
