The Driver Information Systems (Exemption) Order 1990

The Secretary of State for Transport as respects England, the Secretary of State for Scotland as respects Scotland and the Secretary of State for Wales as respect Wales, in exercise of the powers conferred on them by section 9(2) of the Road Traffic (Driver Licensing and Information Systems) Act 1989 (1), and of all other enabling powers, hereby make the following Order:

1. This Order may be cited as the Driver Information Systems (Exemption) Order 1990 and shall come into force on 1st June 1990.

2.-(1) It is hereby directed that Part II of the Road Traffic (Driver Licensing and Information Systems) Act 1989 shall not apply to any description of driver information system other than a system which has the characteristics set out in sub-paragraph (a) or (b) or both below-

(a)it is a system whose operation requires the installation in, upon, under, over, along or across a public road of system apparatus capable of transmitting data to, or collecting information from, motor vehicles or both; or

(b)subject to paragraph (2) below, it is a system which, when in operation, will-

(i)have as its primary purpose, or one of its primary purposes, the provision during the course of a journey of specificdirections to the driver of a motor vehicle as to the precise route which that vehicle should follow for the purposes of that journey, in such manner that the directions may be revised as traffic conditions change during the course of that journey,

(ii)use equipment in motor vehicles which has been designed to give the specific directions referred to in item (i) above, and

(iii)be available for use by the public.

(2) Part II of the said Act shall in addition not apply to any description of driver information system which has the characteristics referred to in paragraph (1)(b) (but not (a)) above and which is operated by a person who transmits data to motor vehicles as part of a service provided by him to a licensed operator of a driver information system.

This Order specifies those descriptions of driver information systems to which Part II of the Road Traffic (Driver Licensing and Information Systems) Act 1989 does not apply.
