In exercise of the powers conferred on me by section 102(4) of theFinance (No. 2) Act 1987(1), a draft of this instrument having been laid before, andapproved by a resolution of, the House of Commons, I hereby make thefollowing Order:
1. This Order may be cited as the Data Protection Registration FeeOrder 1991 and shall come into force on the day after the day on whichit is made.
2.-(1) In relation to the functions mentioned in paragraph (2) below thecosts of which fall to be taken into account on the exercise of thepowers to fix the fees to which paragraph (3) below applies, thefollowing matter, namely, any deficit incurred before the exercise ofthe relevant power, is hereby specified for the purposes of section102(4) of the Finance (No. 2) Act 1987 as one which may be taken intoaccount in determining those costs.
(2) The said functions are those of the Data Protection Registrar, ofthe Data Protection Tribunal, and of the Secretary of State in respectof that Tribunal, under the Data Protection Act 1984(2).
(3) This paragraph applies-
(a)to the fee payable under section 6(7) of that Act on an applicationfor registration under that Act; and
(b)to the fee payable under section 8(5) of that Act on an applicationfor the renewal of registration under that Act.

This Order provides that past deficits may be taken into account inthe determination of fees fixed by the Home Secretary for applicationsfor registration and the renewal of registration under the DataProtection Act 1984.
