The Secretary of State for Transport, in exercise of the powers conferred on him by sections 25(1) and (2), 26(1) and (3)(d), 44(3) and 46(1)(1) of the Dartford-Thurrock Crossing Act 1988(2), and of all other enabling powers, hereby makes the following Regulations:

1. These Regulations may be cited as the Dartford-Thurrock Crossing (Amendment) Regulations 1991 and shall come into force on 1st September 1991.

2. The Dartford-Thurrock Crossing Regulations 1989(3) shall be amended in accordance with the following provisions of these Regulations.

3. For regulation 2 there shall be substituted the following-�

"2.-(1) No person shall, except with the permission of the crossing operator, take or cause or permit to be taken-�

(a)into the tunnels any vehicle which exceeds any of the dimensions or weights set out in column (1) of the table below;

(b)onto the bridge any vehicle which exceeds any of the dimensions or weights set out in column (2) of the table below.

(2) In paragraph (1) above references to a vehicle shall be taken to include any load carried and any trailer drawn by the vehicle.".

4. For regulation 5 there shall be substituted the following-�

"5.-(1) The driver of a vehicle, or a person on his behalf, shall pay to the crossing operator, in addition to any toll payable for the use of the crossing by that vehicle-�

(a)for the use of the tunnels by that vehicle, a charge as set out in Part I of the table below;

(b)for the use of the bridge by that vehicle, a charge as set out in Part II of the table below.

(2) Where the overall width and overall length, or one or both of these and the total weight, of a vehicle each renders a person liable to pay a charge, then that person shall be liable to pay one charge only, which shall be the highest or the jointhighest of the charges prescribed in respect of that vehicle in the table in paragraph (1) above.

(3) In this regulation references to a vehicle shall be taken to include any load carried and any trailer drawn by the vehicle."

5. In regulation 6 (Dangerous goods) in paragraph (1) for the words "5th edition issued in 1989" there shall be substituted "6th edition issued in 1991"(4).

6. In regulation 12(1), for the table there set out there shall be substituted the table below.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Dartford-Thurrock Crossing Regulations 1989 in the following ways.

First, by substituting for the old regulation 2 a new one to ensure that, once the bridge is open, certain specified abnormal loads do not use it without the crossing operator's consent. The new regulation 2 replicates the old in so far as use of the tunnels by abnormal loads is concerned.

Secondly, by substituting for the old regulation 5 a new one which (a) increases the charges to be made in respect of vehicles above a specified width or length which use the crossing and (b) introduces a charge to be made in respect of vehicles above a specified weight which use the crossing. (These charges are in addition to any tolls which may be levied in respect of those vehicles.)

Thirdly, by increasing the minimum and three of the four additional charges used to calculate the fee payable under regulation 12 of the 1989 Regulations in respect of the attendance at or the removal of a vehicle which has broken down on the crossing.

Finally, by ensuring that regulation 6 of the 1989 Regulations refers to the sixth, and latest, edition of the booklet entitled "Dangerous Traffic".
