The Secretary of State, in exercise of the powers conferred on him by section 248(4), (8), (9) and (11) of the Housing (Scotland) Act 1987((1)) and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Order, a draft of which has been laid before and approved by resolution of the House of Commons:
1. This Order may be cited as the Housing (Percentage of Approved Expense for Repairs Grants) (Lead Plumbing and Radon Gas Works) (Scotland) Order 1992 and shall come into force on 16th July 1992.
2. Where an application for a repairs grant is in respect of works-
(a)to replace in a different material pipes, tanks, cisterns, taps or other equipment used for the supply of water to a house and wholly or partly made of lead; or
(b)to reduce substantially the level of radon gas in a house where the annual average level of radon gas in that house exceeds 200 becquerels per cubic metre,
the percentage prescribed under section 248(4) of the Housing (Scotland) Act 1987 shall be 90 per cent((2)).
3. The Housing (Percentage of Approved Expense for Repairs Grants) 0(Lead Plumbing Works) (Scotland) Order 1984((3)) is hereby revoked.

The amount of grant for the repair of a house is determined by section 248(4) of the Housing (Scotland) Act 1987 which provides for a maximum grant of 50 per cent of the approved expense of the works to be carried out. The Act also enables other percentages to be prescribed by Order made by the Secretary of State and different provision may be made for different cases or descriptions of case.
This Order prescribes a new maximum percentage of 90 per cent of the approved expense in respect of an application where the works are in respect of the replacement of lead plumbing or the reduction of levels of radon gas in a house. Previously a maximum of 75% applied to lead plumbing works and the normal maximum of 50% to all other cases.
1987 c. 26; section 248 was amended by paragraph 14 of Schedule 7 and paragraph 6(b) of Schedule 8 to the Housing (Scotland) Act 1988 (c. 43).
The 50% specified in section 248(4) of the consolidating Housing (Scotland) Act 1987 was originally specified in section 10A(4) of the Housing (Scotland) Act 1974 (c. 45) and changed to 75% in relation to lead plumbing works by S.I. 1984/514.
