The Secretary of State, in exercise of the powers conferred on him by section 43(2) of the Salmon Act 1986(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1.-(1) This Order may be cited as the Salmon Act 1986 (Commencement and Transitional Provisions) Order 1992.
(2) In this Order "the 1986 Act" means the Salmon Act 1986.
2. Section 21 of the 1986 Act shall come into force on 1st January 1993.
3. Where proceedings for an offence of illegal fishing under section 2 of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951(2) were commenced but have not been completed before the coming into force of subsection (1A) of that Act and before the coming into force of the Salmon (Definition of Methods of Net Fishing and Construction of Nets) (Scotland) Regulations 1992 the offence shall continue to be dealt with, inquired into and tried and determined as if the said subsection (1A) and the said Regulations had not come into force.

This order brings into force section 21 of the Salmon Act 1986 on 1st January 1993. All the other provisions of the Act were brought into force on 7th January 1987.
This order also provides for proceedings concerning illegal fishing already commenced before 1st January 1993 to continue to be dealt with. The Salmon (Definition of Methods of Net Fishing and Construction of Nets) (Scotland) Regulations 1992 will be brought into force on 1st January 1993.
