The Olive Oil (Marketing Standards) (Amendment) Regulations 1992

The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Economic Community, acting jointly in exercise of the powers conferred upon them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:-

Title, extent, commencement and interpretation

1.-(1) These Regulations, which extend to Great Britain, may be cited as the Olive Oil (Marketing Standards) (Amendment) Regulations 1992 and shall come into force on1st November 1992.

(2) In these Regulations "the principal Regulations" means the Olive Oil (Marketing Standards) Regulations 1987(3).

Amendment of the principal Regulations

2.-(1) In regulation 2(1) of the principal Regulations, in the definition of "the Council Regulation", for the words " Council Regulation (EEC) No. 1915/87" there shall be substituted the words "Council Regulations (EEC) No. 1915/87(4) and (EEC)No. 356/92(5)".

(2) In regulation 2(1) of the principal Regulations, in the definition of "oil", there shall be inserted immediately after the words "the Annex to that Regulation" the words "as read with Commission Regulation (EEC) No. 2568/91 (as amended)(6)".

(3) In regulation 4(1) of the principal Regulations there shall be inserted immediately after the words "as read with the Annex thereto" the words "and with Commission Regulation (EEC) No. 2568/91 (as amended)".

(4) In regulation 4(3) of the principal Regulations there shall be inserted immediately after the words "with that Annex" the words "and with Commission Regulation (EEC) No. 2568/91 (as amended)".

(5) Immediately after regulation 5 of the principal Regulations there shall be inserted the following regulation-

"Methods of analysis

5A. Where, for the purposes of enforcing these Regulations, an analysis is made of any oil, the method, or methods, of such analysis shall be that, or those, prescribed by Commission Regulation (EEC) No. 2568/91 (as amended).".

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 1st November 1992 and which apply to Great Britain, amend the Olive Oil (Marketing Standards) Regulations 1987.

The amendments made by these Regulations-

(1) implement those provisions of Council Regulation (EEC) No. 356/92 (OJ No. L39, 15.2.92, p.1) and Commission Regulation (EEC) No. 2568/91 (OJ No. L248, 5.9.91, p.1 (as amended by Commission Regulation (EEC) No. 1429/92, OJ No. L150, 2.6.92, p.17) which introduced changes to the definitions of categories of olive oil contained in Regulation No. 136/66/EEC of the Council (OJ No. 172, 30.8.66, p.3025/66; OJ/SE 1965-66, p.221) (as earlier amended) (Regulation 2(1)-(4)), and

(2) require that where any analysis of olive oil is made for the purposes of the 1987 Regulations the method, or methods, used shall be those prescribed by Council Regulation (EEC) No. 2568/91 (as amended) (Regulation 2(5)).
