The Friendly Societies Act 1992 (Consequential Provisions) (No. 2) Regulations 1993

The Treasury, in exercise of the powers conferred on them by section 123(1) of the Friendly Societies Act 1992(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the Friendly Societies Act 1992 (Consequential Provisions) (No. 2) Regulations 1993.

(2) These Regulations shall come into force on 24th May 1993.

(3) In these Regulations-�

"central office" has the meaning given to that term in section 119(1) of the Friendly Societies Act 1992;

"Chief Registrar" means the Chief Registrar of friendly societies;

"Commission" means the Friendly Societies Commission established under section 1 of the Friendly Societies Act 1992;

"Commissioner" means the Industrial Assurance Commissioner.

Disclosure of information to the Commission

2. Any information, documents or other material furnished to the Chief Registrar, the central office or the Commissioner under any enactment may be disclosed to the Commission for the purpose of enabling or assisting the Commission to discharge any of its functions under the enactments relating to friendly societies or under the Financial Services Act 1986(2).

Effect of awards by the Commissioner

3. Where under section 45(2) of the Industrial Assurance Act 1923(3) the Commissioner awards that a collecting society be dissolved and its affairs wound up, the award shall be made and notified to the central office in the same manner and shall have the same effect as if it were an award made under section 95A of the Friendly Societies Act 1974 and may direct in what manner the assets of the collecting society are to be divided or appropriated but without prejudice to the proviso to section 45(2) of the Industrial Assurance Act 1923.

Explanatory Note

(This note is not part of the Regulations)

These Regulations make consequential provisions in connection with the bringing into force by the Friendly Societies Act 1992 (Commencement No. 5 and Savings) Order 1993 (S.I. 1993/1186 (C. 23)) of certain provisions of the Friendly Societies Act 1992. They enable information furnished to the Chief Registrar, the central office or the Industrial Assurance Commissioner under any enactment to be disclosed to the Commission to facilitate the discharge of its statutory functions and provide that an award dissolving a collecting society under the Industrial Assurance Act 1923 is to have effect as if it were made under section 95A of the Friendly Societies Act 1974 which replaced section 95 of that Act in relation to registered friendly societies by virtue of the Friendly Societies Act 1992.
