The Secretary of State for Transport makes this Instrument in exercise of powers conferred by Sections 106(3) and 108(4) of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:-

1. The Sandwell Borough Council (Patent Shaft/Moorcroft Infrastructure) (Walsall Canal Bridge) Scheme 1993 is hereby confirmed with modifications.

2. The said Scheme as confirmed (hereinafter referred to as "the Scheme") is set out in the Schedule hereto and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY, and at the offices of the Chief Executive, Sandwell Borough Council, Sandwell Council House, Oldbury, Warley, West Midlands.

3. The Scheme will become operative on the date on which notice that it has been confirmed is first published in acccordance with paragraph 1 of chedule 2 to the Highways Act 1980.

4. This Instrument may be cited as the Sandwell Borough Council (Patent Shaft/ Moorcroft Infrastructure) (Walsall Canal Bridge) Scheme 1993 Confirmation Instrument 1993.

THE SCHEDULETHE SANDWELL BOROUGH COUNCIL (PATENT SHAFT/MOORCROFT INFRASTRUCTURE) (WALSALL CANAL BRIDGE) SCHEME 1993

The Council of the Borough of Sandwell (hereinafter referred to as "the Council") make this Scheme in exercise of its powers under Sections 106(3) and 108(4) of the Highways Act 1980 and of all other enabling powers:-�

1. The Council are authorised to construct over the navigable waters of the Walsall Canal the bridges specified in the Schedule to this Scheme as part of the highway to be constructed by The Black Country Development Corporation in connection with the Patent Shaft/Moorcroft Development Site, Wednesbury in the said Borough, and which bridges are to become highways maintainable by public expense upon completion.

2. The Council are also authorised in connection with the construction of the said bridges to divert part of the navigable watercourse specified in the said Schedule and the towing path adjacent to that part in the manner shown in that Schedule.

3. This Scheme may be cited as the Sandwell Borough Council (Patent Shaft/Moorcroft Infrastructure) (Walsall Canal Bridge) Scheme 1993.

SCHEDULE

LOCATION
The two bridges will span the Walsall Canal near to the intersection of the said Canal with the disused Bradley Locks branch at distances of approximately 680 metres and 890 metres respectively north of Leabrook Road, Wednesbury in the Borough of Sandwell.

The minimum clear span of each bridge will be 11 metres.

The minimum width of waterway will be 7 metres and a 2.5 metres towpath will be provided on the north-�eastern side with a 1.5 metre maintenence strip on the south-�western side.

The minimum headroom under each bridge provided over the 7 metre width of waterway will be 2.7 metres above the British Waterways Board Design level of 124.48 metres above Ordinance Datum.

DIVERSION OF WATER COURSE AND TOW PATH
Walsall Canal.
PARTICULARS OF DIVERSION
The existing canal width varies between 12 metres and 18 metres approximately and will be reduced to a minimum width of 7 metres over lengths of 35 metres at each bridge to facilitate the construction of the bridges.
