The A249 Trunk Road (M2 to Bobbing Improvement Slip Roads) Order 1993

Coming into force

23rd March 1993

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:-

1. The new highways which the Secretary of State proposes to construct along the routes described in the Schedule to this Order (the highways along these routes being in this Order referred to as "the slip roads"), shall become trunk roads as from the date when this Order comes into force.

2. The centre line of each of the slip roads is indicated by a heavy black line on the deposited plan.

3. The Secretary of State directs as respects any part of a highway which crosses the route of any of the slip roads that-

(a)where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

(b)where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.

4. In this Order-

(1) all measurements of distance are measured along the route of the relevant highway;

(2) (i) "the deposited plan" means the plan folio numbered PSE/O/A249/4/65/2/2 marked "The A249 Trunk Road (M2 to Bobbing Improvement Slip Roads) Order 1993" signed by authority of the Secretary of State and deposited at the Department of Transport, Rom-ney House, 43 Marsham Street, London SW1P 3PY, which folio contains two site plans numbered respectively "1" and "2";

(ii)"the main new trunk road" means the highway along the route described in paragraph 2 of the Schedule to the A249 Trunk Road (M2 to Bobbing Improvement) Order 1993(3) which is to be constructed by the Secretary of State in pursuance of that Order;

(iii)"the trunk road" means the A249 Trunk Road.

5. This Order shall come into force on 23rd March 1993 and may be cited as the A249 Trunk Road (M2 to Bobbing Improvement Slip Roads) Order 1993.

THE SCHEDULEROUTES OF THE SLIP ROADS

Routes of the slip roads at Key Street, near Sittingbourne, and Bobbing in the County of Kent, are as follows-

1. JUNCTION OF THE TRUNK ROAD WITH THE A2 AT KEY STREET, NEAR SITTINGBOURNE:-

(a)a route from the northeastbound carriageway of the trunk road, as proposed to be improved by the Secretary of State, to a roundabout to be constructed by him in pursuance of the A249 Trunk Road (M2 to Bobbing Improvement Side Roads) Order 1993, the slip road along this route being given the reference number 1 on site plan 1 of the deposited plan; and

(b)a route from that roundabout to the southwestbound carriageway of the trunk road, as proposed to be improved by the Secretary of State, the slip road along this route being given the reference number 2 on site plan 1 of the deposited plan.

2. JUNCTION OF THE MAIN NEW TRUNK ROAD WITH THE TRUNK ROAD AT BOBBING-

(a)a route from the northeastbound carriageway of the main new trunk road to a point on a roundabout south of Bobbing County Primary School to be constructed by the Secretary of State in pursuance of the A249 Iwade Bypass Order 1992, the slip road along this route being given the reference number 3 on site plan 2 of the deposited plan; and

(b)a route from that roundabout to the southwestbound carriageway of the main new trunk road, the slip road along this route being given the reference number 4 on site plan 2 of the deposited plan.
