The Dumfries and Galloway Region (Electoral Arrangements) Order 1993

Made

30th March 1993

Coming into force in accordance with Article 1(2)

Whereas under section 17(1) of the Local Government (Scotland) Act 1973((1)) the Local Government Boundary Commission for Scotland on 2 July 1992 submitted to the Secretary of State a report on a review together with its proposals for a change of the electoral arrangements for the Dumfries and Galloway Region;

Now, therefore, in exercise of the powers conferred on him by sections 17(2) and 233 of the said Act and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order:

Citation and commencement

1.-(1) This Order may be cited as the Dumfries and Galloway Region (Electoral Arrangements) Order 1993.

(2) This Order shall come into force on 5th May 1994:

Provided that for the purpose of all proceedings preliminary or relating to an election to be held on or after that day the said Order shall come into force on 10th October 1993.

Interpretation

2. In the Schedule to this Order-�

(a)a reference to-�

(i)an electoral division shall be construed as a reference to that electoral division as constituted in this Order;

(ii)a road, footpath, railway line, river, burn or canal shall, where the context so admits, be construed as the centre line of the feature concerned; and

(iii)the boundary or boundaries of a parish is to a line corresponding as nearly as may be to the line of the boundary or boundaries of the parish concerned as already published on Ordnance Survey maps;

(b)the expedient of defining a line beyond Mean Low Water Springs has been adopted to apportion islands to the appropriate electoral division; and

(c)the following abbreviations are used:-�

Change of electoral arrangements

3. The existing electoral divisions of the Dumfries and Galloway Region shall be abolished and the said Region shall be divided into thirty-five electoral divisions having the names, contents and boundaries set forth in the Schedule to this Order.

4. The boundaries of the electoral divisions constituted by this Order shall be defined and mered by Ordnance Survey.

Revocation

5. Without prejudice to its continuing in effect for the purposes of defining the electoral divisions prior to the coming into force of this Order, the Dumfries and Galloway Region (Electoral Arrangements) Order 1977((2)) is hereby revoked.

SCHEDULEDESCRIPTIONS OF BOUNDARIES OF ELECTORAL DIVISIONS FOR THE DUMFRIES AND GALLOWAY REGION

Electoral Division 1: Cree

Commencing on the southern boundary of Dumfries and Galloway Region and Wigtown District at the mouth of the River Cree; then generally northwestward along the River Cree to a point opposite Goods Lane; then generally westward along Goods Lane, Dashwood Square, Princes Street and St Couan's Road to the unclassified road leading northward past South Barnkirk and North Barnkirk; then northward along the said road and its prolongation in a straight line, crossing the A714 road, to the River Cree; then generally northwestward and westward along the River Cree to and generally northward and eastward along the northern boundary of Dumfries and Galloway Region and Wigtown District to the eastern boundary of Wigtown District; then generally southward along the said district boundary to and northwestward along the southern boundary of Dumfries and Galloway Region and Wigtown District to the point of commencement.

Electoral Division 2: Machars

Commencing on the southern boundary of Dumfries and Galloway Region and Wigtown District at the western boundary of ED 1 (Cree) at the mouth of the River Cree; then generally southward and northwestward along the said regional and district boundary to a point in line with the line of field boundaries leading from Knockgulsha to the A747 road west of Low Craiglemine; then northeastward along the said line of field boundaries to and continuing northeastward along the A747 road to the unclassified road leading northward past Appleby and Moss Park to where that road is intersected by the western boundary of the parish of Sorbie; then generally northwestward in a straight line to where the southern boundary of the parish of Kirkinner leaves the Dowalton Burn; then generally westward along the southern boundary of the parish of Kirkinner to its intersection with field boundaries leading southeastward from Airyhassen; then generally northwestward along the said field boundaries to and along the minor road from Airyhassen to Mochrum to its intersection with the Barmullan Burn; then generally northward along the Barmullan Burn to its intersection with the western boundary of the parish of Kirkinner and continuing northward along the said parish boundary to its intersection with the western boundary of the parish of Wigtown on the River Bladnoch; then generally northward and eastward to the point of commencement.

Note ED 9 includes all islands in the parishes of Rerrick and Buittle.

Electoral Division 10: Stewartry East

Commencing on the southern boundary of Dumfries and Galloway Region and Stewartry District at the eastern boundary of ED 9 (Stewartry Screel); then generally northward along the said ED boundary to the western boundary of the field immediately to the south of West Glenarm; then generally northwestward along the said field boundary and continuing by field boundaries parallel to the course of the footpath from West Glenarm to Nether Auchenreoch to the track leading eastward from Nether Auchenreoch; then generally eastward along the said track to and generally northward along the unclassified road from West Glenarm to Crocketford to the unnamed burn flowing east to Milton Loch from the dam south of Auchengibbert; then eastward along the said burn to and in a straight line northeastward crossing Milton Loch to the unnamed burn at grid reference NX 8443 7226; then generally northward along the said burn to and continuing generally northward and eastward along the eastern boundary of the parish of Urr to the eastern boundary of Stewartry District; then generally eastward and southward along the said district boundary to and generally southwestward along the southern boundary of Dumfries and Galloway Region and Stewartry District to the point of commencement.

Commencing on the western boundary of Stewartry District at its intersection with the River Dee; then generally northward, eastward and southward along the western, northern and eastern boundaries of Stewartry District to the northern boundary of ED 10 (Stewartry East); then generally southwestward along the northern boundary of ED 10 to and along the northern boundaries of ED 9 (Stewartry Screel) and ED 8 (Castle Douglas) to the roundabout on the A75(T) south of Castle Douglas; then generally westward along the A75(T) to the Mill Burn; then generally northward to the River Dee; then generally northwestward along the River Dee to the point of commencement.

Electoral Division 12: Stewartry West

Commencing at the junction of Brooms Road and Eastfield Road at grid reference NX 9807 7606; then generally northeastward along Brooms Road to and eastward along Annan Road to Georgetown Road; then generally southeastward and southwestward along the eastern boundary of ED 19 (Lochar) to the eastern boundary of ED 20 (Crichton) at Craigs Farm; then generally northwestward along the said ED boundary to the point of commencement.

Electoral Division 22: St Marys

Electoral Division 26: Lochside

Commencing on the eastern boundary of ED 16 (West Nithsdale) at the junction of Hardthorn Road and Alloway Road at grid reference NX 9551 7716; then generally northwestward and northeastward along the said ED boundary to its intersection with the northern boundary of ED 25 (Maryholm) at Newbridge; then generally southeastward, northwestward and southwestward along the western boundary of ED 25 to the point of commencement.

Electoral Division 27: Annan West

Commencing on the southern boundary of Dumfries and Galloway Region and Annandale and Eskdale District at the eastern boundary of the parish of Cummertrees; then northwestward to grid reference NY 1630 6530; then generally northward along the said parish boundary to the A75 Dumfries/Annan road; then generally northwestward along the A75 to its junction with the minor road leading from Hoddom Mains and Kelhead; then generally northward along the said road to its junction with the B725 road near Hoddom Mains; then generally eastward along the B725 road and northward along the B723 road to the River Annan; then generally eastward and southward along the River Annan to the A75(T) Annan By-Pass; then eastward along the A75(T) to its intersection with North Street; then generally southward along North Street, eastward along Johnstone Street, southward along Butts Street, eastward along Church Street and Scott's Street to the pipeline where it passes under Scott's Street; then generally southward along the said pipeline to its visible limit and then continuing southward by following the dismantled railway to the point where it meets the sea then southward to the southern boundary of Dumfries and Galloway Region and Annandale and Eskdale District; then generally westward to the point of commencement.

Electoral Division 28: Annan East

Commencing on the eastern boundary of ED 27 (Annan West) at the intersection of the A75(T) Annan By-Pass and North Street at grid reference NY 1961 6777; then generally eastward along the A75(T) to its intersection with Prestonfield Road; then generally southwestward along Prestonfield Road to a point in line with the field boundary south of the access road to the nursery school and leading southeastward past the said access road and the western curtilages of Nos 4-1, Springbells; then southeastward along the said field boundary to Hospital Road and northeastward along Hospital Road to Springbells Road; then southeastward along Springbells Road to and southwestward along the course of the pipeline leading southward to Scott's Street; then generally westward and northward along the eastern boundary of ED 27 to the point of commencement.

Electoral Division 29: Chapelcross

Commencing on the southern boundary of Dumfries and Galloway Region and Annandale and Eskdale District at the eastern boundary of ED 27 (Annan West); then northwestward to grid reference NY 2065 6441; then generally northward, westward and northward along the eastern boundary of ED 27 and the eastern and northern boundary of ED 28 (Annan East) to the bridge carrying Bridge Street, Brydekirk; then northeastward along the unclassified road forming the extension of Bridge Street to its crossing of the unnamed burn flowing southeastward into the Bonshaw Burn; then generally southeastward along the said burn, the Bonshaw Burn and Kirtle Water to the bridge carrying the unclassified road south of Merkland; then generally southward, by unclassified roads, passing to the west of Blackyett turning southward onto the B6357 road west of Broats; then generally southwestward along the said B6357 to its intersection with the eastern boundary of the parish of Dornock at Dornock Burn; then generally southward along the said parish boundary to the southern boundary of Dumfries and Galloway Region and Annandale and Eskdale District and generally westward to the point of commencement.

Commencing on the southern boundary of Dumfries and Galloway Region and Annandale and Eskdale District at the eastern boundary of ED 29 (Chapelcross); then northeastward to grid reference NY 2554 6445; then generally northward along the said ED boundary to the Kirtle Water; then generally southeastward along the Kirtle Water to the track leading south from Grahamshill Cottages; then generally northward along the said track and the continuation thereof to a drainage ditch; then eastward to the Rae Burn; then generally eastward along the said burn to the eastern boundary of the parish of Kirkpatrick Fleming; then generally northward along the said parish boundary to its intersection with the northern boundary of the parish of Half Morton just northeast of Kennedy's Corner; then generally eastward and southward along the said parish boundary to the southern boundary of Scotland, Dumfries and Galloway Region and Annandale and Eskdale District; then generally southward and westward along the said boundary to the point of commencement.

Commencing on the eastern boundary of Dumfries and Galloway Region and Annandale and Eskdale District at the western boundary of Canonbie parish at grid reference NY 3299 7367; then generally northward along the western boundaries of the parishes of Canonbie, Langholm, Westerkirk and Eskdalemuir to the northern boundary of Dumfries and Galloway Region and Annandale and Eskdale District; then generally eastward and southeastward along the said boundary to the point of commencement.

Commencing on the northern boundary of ED 34 (West Annandale) and the southern boundary of ED 33 (Upper Annandale) on the A74(T) Glasgow/Carlisle road at grid reference NY 1281 8387; then generally northeastward along the southern boundary of ED 33; then southward and southwestward along the western boundary of ED 32 (Burnswark), and northward along the eastern boundary of ED 34 to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order gives effect to proposals made by the Local Government Boundary Commission for Scotland for a change to electoral arrangements for the Dumfries and Galloway Region (the Region) as described in the Schedule to the Dumfries and Galloway Region (Electoral Arrangements) Order 1977 ("the 1977 Order").

The effect of the proposals is to divide the Region into 35 electoral divisions as described in the Schedule to this Order.

The 1977 Order is revoked by this Order.
