The Secretary of State for Education, in exercise of the powers conferred on him by section 231(2) and (3)(d) of the Education Reform Act 1988(1), hereby makes the following Order:

Citation and commencement

1.-(1) This Order may be cited as the Education (Inner London Education Authority) (Property Transfer) (Amendment) Order 1994 and shall come into force on 1st June 1994.

Interpretation

2. In this Order-

"the principal Order" means the Education (Inner London Education Authority) (Property Transfer) Order 1990(2).

Amendment of the principal Order

3.-(1) The property known as Grafham Grange School, Bramley, Near Guildford, Surrey, GU5 0LH (which property was transferred to the London Borough of Lewisham by article 4 of and Schedule 9 to the principal Order) shall not be treated for the purposes of condition C specified in the principal Order as having ceased to be used wholly or mainly for the purposes of Lewisham's LEA functions if, at any time when it is not so used, it is used for the purposes of a special school which is not maintained by a local education authority.

(2) The proposed or actual disposal by Lewisham of any interest in the property to persons intending to use it for such purposes shall not be taken for the purposes of condition C to indicate a wish to dispose of the property.

Explanatory Note

(This note is not part of the Order)

This Order amends the Education (Inner London Education Authority) (Property Transfer) Order 1990, which transferred the premises of Grafham Grange School to the London Borough of Lewisham subject to (inter alia) a condition that if the premises cease to be used for Lewisham's purposes as a local education authority, or if Lewisham wishes to dispose of them, they should be offered to the other inner London councils and, if none is willing to accept them, sold and the proceeds distributed to the councils. The amendment disapplies that condition while the premises are used for the purposes of a non-maintained special school. It also provides that disposing of the premises to persons who intend to conduct such a school on them is not to be treated for the purposes of the condition as indicating a wish to dispose of them.
