CHANGES IN LOCAL GOVERNMENT AREAS

Whereas the Local Government Boundary Commission for Wales, under sections 54 and 58(1) of the Local Government Act 1972(1), made proposals to the Secretary of State for Wales for the transfer of parts of the City of Cardiff to the Borough of Vale of Glamorgan and of parts of the Borough of Vale of Glamorgan to the City of Cardiff;
And whereas a period of more than six weeks has elapsed since those proposals were made;
And whereas the Secretaty of State for Wales is satisfied that the transfers should be effected as proposed;
Now, therefore, the Secretary of State for Wales, in exercise of his powers under sections 58(2) and 67(4) of the said Act and of all other powers enabling him in that behalf, hereby makes the following Order:-�
1.-(1) This Order may be cited as the Cardiff and Vale of Glamorgan (Areas) Order 1994.
(2) This Order shall come into force on 1st March 1994 for any purpose set out in regulation 4(1) (Coming into operation of order) of the Local Government Area Changes Regulations 1976(2).
(3) For all other purposes this Order shall come into force on 1st April 1994.
2. In this Order, "the map" means the map issued by the Welsh Office and marked "Map referred to in the Cardiff and Vale of Glamorgan (Areas) Order 1994".
3. Those areas which are described in column (1) of the Schedule shall, in so far as districts, communities, electoral divisions of the County of South Glamorgan, wards of districts or communities and petty sessional divisions are specified in respect thereof in columns (2) to (7), be transferred to or form part of such areas.
4. The Vale of Glamorgan and Cardiff petty sessional divisions shall consist of the Borough of Vale of Glamorgan and the City of Cardiff respectively as altered by article 3.
5.-(1) In this article, "provision" means a provision of a development plan as defined in section 336(1) of the Town and Country Planning Act 1990(3) or, as the case may be, the old development plan within the meaning of paragraph 1 of Part III of Schedule 2 to that Act.
(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.
6. Notwithstanding the area changes effected by this Order, the references to the City of Cardiff in paragraphs 3(3), 5(1) and 6 of Schedule 7 to the Cardiff Bay Barrage Act 1993(4) shall be construed as if its boundary remained as it existed immediately before the passing of that Act.

This Order alters the boundary between the City of Cardiff and the Borough of Vale of Glamorgan by transferring:
(a)parts of the City of Cardiff (and of the Communities of St Fagans, Ely and Caerau) to the Borough of Vale of Glamorgan (and the Communities of St Georges-�super-�Ely and Wenvoe); and
(b)parts of the Borough of Vale of Glamorgan (and of the Communities of St Georges-�super-�Ely, Wenvoe and Michaelston) to the City of Cardiff (and the Communities of St Fagans, Ely and Caerau).
The areas in (a) have an area of about 102 hectares and a population of about 230. The areas in (b) have an area of about 140 hectares and a population of about 250.
The map forming part of this note gives a general indication of the areas affected by the Order.
Prints of the boundary map referred to in article 2 of the Order are deposited and may be inspected during normal office hours at the offices of the Borough Council of Vale of Glamorgan, Holton Road, Barry, the City Council of Cardiff, City Hall, Cathays Park, Cardiff and at the offices of the Secretary of State for Wales at Cathays Park, Cardiff.
Article 6 of the Order maintains the geographical area to which the protection provisions in certain paragraphs of the scheme for groundwater damage protection set out in Schedule 7 to the Cardiff Bay Barrage Act 1993 apply.
The Local Government Area Changes Regulations 1976 referred to in article 1 of the Order contain further provisions about the effect and implementation of orders such as this one.
1990 c. 8. This definition was amended by the Planning and Compensation Act 1991 (c. 34), Schedule 4, paragraph 34.
