The Secretary of State for Health, in exercise of the powers conferred by paragraph 4(1) and (2)(b) of Schedule 4, paragraph 7(1) and (2)(b) of Schedule 5 and paragraph 10(1) and (2)(b) and (c) of Schedule 6 to the Children Act 1989(1) and of all other powers enabling her in that behalf hereby makes the following Regulations:
1. These Regulations may be cited as the Children's Homes Amendment Regulations 1994 and shall come into force on 4th July 1994.
2. In regulation 14 (fire precautions) of the Children's Homes Regulations 1991(2) for paragraph (2) there shall be substituted the following paragraph-
"(2) The responsible authority shall ensure that in respect of the home-
(a)precautions are taken against the risk of fire,
(b)means of escape in the event of fire are provided,
(c)arrangements are made for detecting, containing and extinguishing fire,
(d)arrangements are made for warning of an outbreak of fire and for evacuation in the event of fire, and
(e)means for fighting fire are provided,
which are such as may reasonably be required in respect of that home.".
3. Regulation 2(10) of the Children (Homes, Arrangements for Placement, Reviews and Representations) (Miscellaneous Amendments) Regulations 1993(3) is revoked.

These Regulations amend regulation 14(2) of the Children's Homes Regulations 1991 by requiring the responsible authority for any children's home to ensure that certain precautions are taken against the risk of fire and to contain and reduce the risk to the children in the case of an outbreak of fire (regulation 2). They revoke a provision of earlier amending Regulations which contained an incorrect reference to fire certificates (regulation 3).
