Coming into force in accordance with regulation 1
Whereas the Secretary of State pursuant to section 86(2) of the Weights and Measures Act 1985(1) has consulted organisations appearing to him to be representative of interests substantially affected by these Regulations and has considered the representations made to him by organisations with respect to the subject matter of these Regulations:
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by sections 15(1)(g), 23(1)(a) and (d), 48(1)(a), 48(1A)(ii), 49, 65, 66, 68(1), 68(1A)(a) and 94(1) of the Weights and Measures Act 1985 and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Weights and Measures (Packaged Goods and Quantity Marking and Abbreviations of Units) (Amendment) Regulations 1994 and shall come into force immediately after the coming into force of the Units of Measurement Regulations 1994(2).
2.-(1) On the coming into force of these Regulations the Regulations specified in Part I of the Schedule to these Regulations shall be amended in the manner specified in that Part.
(2) On 1st October 1995 the Regulations specified in Part II of the Schedule to these Regulations shall be amended in the manner specified in that Part.
(3) On 1st January 2000 the Regulations specified in Part III of the Schedule to these Regulations as amended by paragraph (2) above shall be amended in the manner specified in that Part.

| The Weights and Measures (Quantity Marking and Abbreviations of Units) Regulations 1987 | In regulation 2(2) for "Regulations 5 and 6" substitute "Regulation 5". For regulations 6 and 7 substitute- "6.-(1) Subject to paragraphs (2), (3) and (4) below the marking of any container with information as to quantity by measurement shall be in metric units of measurement. (2) The marking of any returnable container used for milk to which this Part of these Regulations applies with information as to quantity by measurement may, in addition to the marking in metric units, be marked by reference to the pint. (3) The marking of any returnable container used for beer, cider, water, lemonade and fruit juice with information as to quantity by measurement may, in addition to the marking in metric units, be marked by reference to the pint and the fluid ounce. (4) Any container marked in metric units of measurement in accordancewith these Regulations may be marked with a supplementary indication (section 8(5A) of the Act makes provision for the use for trade of a supplementary indication)." For regulation 8 substitute- "8. Subject to paragraphs (2), (3) and (4) of regulation 6 above the units of measurement to be used in marking any container with information as to quantity by measurement are those set out in column 2 of Schedule 2 to these Regulations appropriate to the measurement being marked set out in column 1." For regulation 11 substitute- "11.-(1) Only those symbols set out in column 2 of Schedule 3 to these Regulations may be used for trade to indicate the relevant unit of measurement set out in column 1 of that Schedule. (2) Where the pint is used in connection with returnable containers for milk or the dispense of draught beer or cider the abbreviation "pt" may be used and the letter "s" may be added, where appropriate, to indicate the plural. (3) Where the pint or the fluid ounce are used in connection with returnable containers for beer, cider, water, lemonade and fruit juice the abbreviations "pt" or "fl oz" may be used and the letter "s" may be added, where appropriate, to indicate the plural. (4) Where the pound or the ounce (avoirdupois) are used in connection with the sale of goods loose from bulk the abbreviations "lb" or "oz" may be used and the letter "s" may be added, where appropriate, to indicate the plural." In Schedule 2 omit column 3. In Schedule 3 omit the words "AND ABBREVIATIONS OF", "PART I" and "METRIC UNITS" and omit Part II. |

These Regulations implement the amendments made by Council Directive 89/617/EEC (OJ No. L 357, 7.12.89, p.28) to Council Directive 80/181/EEC (OJ No. L 39, 15.2.80, p.40) ("the Directive") which relates to the use of units of measurement for economic, public health, public safety or administrative purposes ("the specified circumstances").
They amend the Weights and Measures (Packaged Goods) Regulations 1986 ("the Packaged Goods Regulations") and the Weights and Measures (Quantity Marking and Abbreviations of Units) Regulations 1987 ("the Quantity Marking Regulations").
The amendments made to the Packaged Goods Regulations include the substitution, on 1st October 1995, of metric for imperial quantities in relation to the prescribed maximum capacities of weighing instruments used for making up packaged goods under the system of quantity control known as the "average system".
Those made to the Quantity Marking Regulations require, among other things, catchweight products to be marked, on and after 1st October 1995, with a metric indication of quantity. As a general rule the Quantity Marking Regulations will require, on and after that date, containers to be marked with metric units whilst also permitting supplementary imperial marking.
A Compliance Cost Assessment of the impact that these Regulations will have on business will be available in the libraries of the Houses of Parliament once the Regulations, having been made, are laid before Parliament and from the Consumer Affairs Division of the Department of Trade and Industry, Room 407, 10-18 Victoria Street, London SW1H 0NN.
1985 c. 72; section 68(1) defines "regulations", sections 48(1A) and 68(1A) have effect by virtue of the modifications to Part V of the Act made by paragraphs 2(b) and 8(b) of Part II of Schedule 3 to the Weights and Measures (Packaged Goods) Regulations 1986 and section 94(1) defines "prescribed".

Regulation 9(2)(b) of S.I. 1987/1538 substituted the paragraph 1(B)(c)(ii) of column 2 that is amended by these Regulations.
