The Motor Vehicles (Driving Licences) (Amendment)(No. 2) Regulations 1994

The Secretary of State for Transport, in exercise of the powers conferred on him by sections 92(2), 105(1) and (3), and 108(1)(a) of the Road Traffic Act 1988(1), and after consulting with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

1. These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No. 2) Regulations 1994 and shall come into force on 5th August 1994.

2. The Motor Vehicles (Driving Licences) Regulations 1987(2)shall be amended in accordance with regulation 3 below.

3.-(1) In regulation 24(d) (Disabilities), in paragraph (2), for the words from "the conditions that" to the end of the paragraph there shall be substituted-

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend (with minor drafting alterations) regulation 24(2) of the Motor Vehicles (Driving Licences) Regulations 1987. They alter the conditions which a person suffering from epilepsy has to satisfy if he is to be granted a driving licence. The principal change is that the period during which he must have been free from attacks whilst awake is reduced from two years to one year. As a consequence the provisions as to persons with a history of sleep attacks are slightly affected. A person who last had a sleep attack between one and two years before the granting of the licence now falls within paragraph (a) of regulation 24(2) rather than paragraph (b).
