(This note is not part of the Order)
Section 4(1) and (2) of the Education Reform Act 1988 places a duty on the Secretary of State to establish the National Curriculum by specifying by order appropriate attainment targets, programmes of study and assessment arrangements for each of the foundation subjects. Attainment targets and programmes of study for pupils in the third key stage in the subjects of English, Welsh, mathematics and science ("the relevant subjects") have been specified by the Orders referred to in the second footnote to article 3.
This Order revokes and replaces the Education (National Curriculum) (Assessment Arrangements for English, Welsh, Mathematics and Science) (Key Stage 3) (Wales) Order 1993 as amended. It specifies the assessment arrangements for the relevant subjects in the final year of the third key stage, as they apply to maintained and grant-maintained special schools (not established in a hospital) in Wales.
Pupils are to be assessed by their teachers in relation to each attainment target on the basis of school work, and a record of the results, consisting of pupils' levels of attainment, is to be made by no later than two weeks before the end of the summer term (article 4). National Curriculum tests and tasks known as NC Tests and NC Tasks published by HMSO on behalf of the Secretary of State are to be administered to pupils, their responses to NC Tests provided to an external marking agency to be marked and a record of the results of any NC tasks, consisting of pupils' levels of attainment, is to be made (article 5).
Rules are prescribed for calculating levels of attainment in the subjects using levels in each attainment target as determined by teacher assessment (article 6). These rules are modified in the case of pupils to whom provisions of the National Curriculum do not apply (article 7).
The authority known as Awdurdod Cwricwlwm ac Asesu Cymru or the Curriculum and Assessment Authority for Wales, are required to make arrangements to evaluate the effectiveness of the arrangements made by the Order (article 8). The head teacher is required to provide that authority with samples of pupils' responses to the oral task for Welsh. The Secretary of State is empowered to issue further documents, including NC tests and tasks, to give full effect to the arrangements specified by the Order (article 9).
1988 c. 40; section 4 was amended by section 240 of the Education Act 1993 (c. 35).
The provisions of the National Curriculum apply to grant-maintained special schools which are not established in hospitals by virtue of regulation 42(1) of, and Parts I and II of the Schedule to, the Education (Grant-maintained Special Schools) Regulations 1994, S.I. 1994/653, to which there are amendments not relevant to this Order.

S.I. 1994/647.
As defined in the attainment targets and programmes of study entitled "Welsh" in S.I. 1990/1082.
The current orders for the third key stage are S.I.s 1990/423 (English), 1990/1082 as amended by 1991/1683, 1992/ 1698 and 1992/3140 (Welsh), 1991/2896 (mathematics) and 1991/2897 (science).
The authority now known as Awdurdod Cwricwlwm ac Asesu Cymru or the Curriculum and Assessment Authority for Wales was established by Section 14(1)(b) of the Education Reform Act 1988 under the name of the Curriculum Council for Wales. Its present name was substituted by section 253(1) of the Education Act 1993 (c. 35). The relevant assessment functions were transferred to it by the Education (Schools Curriculum and Assessment Authority) (Transfer of Functions) Order 1994 (S.I. 1994/645).
Section 3(6) was amended by Section 240(3) of the Education Act 1993.
