The Secretary of State for Health, in exercise of the powers conferred on her by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling her in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by Cornwall Health Authority resulting from the establishment of the Cornwall Healthcare National Health Service Trust(2), having consulted the Northern Devon Healthcare National Health Service Trust(3) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
1.-(1) This Order may be cited as the Cornwall Healthcare National Health Service Trust (Transfer of Trust Property) (No. 3) Order 1994 and shall come into operation on 6th October 1994.
(2) In this Order:
"The first Trust" means the Northern Devon Healthcare National Health Service Trust;
"the second Trust" means the Cornwall Healthcare National Health Service Trust;
"the trust property" means the items specified in a schedule of trust property prepared by and agreed upon by the first Trust and the second Trust on 14th December 1993, which schedule has been signed on behalf of both the first Trust and second Trust.
2. On 6th October 1994 the trust property shall be transferred from the first Trust to the second Trust.

This Order transfers to the Cornwall Healthcare National Health Service Trust on 6th October 1994 trust property formerly held by Northern Devon Healthcare National Health Service Trust. A copy of the schedule of trust property to which the Order refers can be obtained at the Department of Health, National Health Service Trust Unit Room IW29, Quarry House, Quarry Hill, Leeds LS2 7UE.
