CHANNEL TUNNEL

The Channel Tunnel (Shop and Liquor Licensing Hours Requirements) (Disapplication) Order 1994

The Secretary of State for Transport, in exercise of the powers conferred on the appropriate Minister by section 11 of the Channel Tunnel Act 1987(1), and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as the Channel Tunnel (Shop and Liquor Licensing Hours Requirements) (Disapplication) Order 1994 and shall come into force on 14th October 1994.

Interpretation

2. In this Order, "the deposited plan" means the plan marked "The Channel Tunnel (Shop and Liquor Licensing Hours Requirements) (Disapplication) Order 1994", signed by authority of the Secretary of State for Transport, dated 16th September 1994 and deposited at the Department of Transport, Parliamentary Library, Room P3/001, 2 Marsham Street, London SW1P 3EB.

Disapplication of Part I of the Shops Act 1950

3. Part I (hours of closing) of the Shops Act 1950(2) shall not apply-

(a)to any shop which is situated within the terminal area of the tunnel system located at the portals of the tunnels in the vicinity of Cheriton, Folkestone, or

(b)to the sale (otherwise than at a shop) of any goods effected within that terminal area by or on behalf of a person carrying on a retail trade business at a shop situated in that terminal area.

Disapplication of section 59 of the Licensing Act 1964

4. Section 59 of the Licensing Act 1964(3) shall not apply in relation to any premises situated in that part of the terminal area referred to in article 3(a) above that is within the area coloured blue on the deposited plan.

Explanatory Note

(This note is not part of the Order)

This Order excludes the application of Part I of the Shops Act 1950, which concerns hours of closing, from any shops situated in the terminal area of the Channel Tunnel system at Cheriton, and from any sales, effected otherwise than at a shop, in the course of retail trade or business at a shop in that area (article 3).

The Order also disapplies section 59 of the Licensing Act 1964 from certain premises at the terminal area mentioned above (article 4).

The deposited plan referred to in article 4 can be seen between 10.00 and 16.00 hours at the Department of Transport at the address given in article 2 of the Order. At the Eurotunnel Customer Service Centre at Cheriton Parc, St. Martin's Plain, Cheriton, Folkestone, a certified duplicate of that plan is deposited and can be inspected during normal office hours.
