The Secretary of State, in exercise of the powers conferred on him by paragraph 3(1)(a) and (7) of Schedule 7 to the Coal Industry Act 1994(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Coal Industry (Retained Copyhold Interests) Regulations 1994 and shall come into force on 31st October 1994.
2. The prescribed form of acceptance notice for the purpose of paragraph 3(1)(a) of Schedule 7 to the Coal Industry Act 1994 shall be the form set out in the Schedule hereto or a form substantially to the like effect.

NOTICE IS HEREBY GIVEN that (a) accepts your title to the retained interest in the coal or mine of coal comprised in or lying under former copyhold land of which you have given notice as mentioned in paragraph 1(1) of Schedule 7 to the Coal Industry Act 1994 and which is described in the Schedule to this notice, and that (a) acknowledges [an obligation under Part 1 of that Schedule 7 to pay compensation in respect of that interest] [that an obligation under Part I of that Schedule 7 to pay compensation will arise if the right under section 49(1) of the said Act in relation to that coal or mine of coal is exercised] (b).
NOTES:
(a)Insert name, and in the first case the address, of the person or body giving the notice.
(b)Insert whichever alternative is applicable.
(c)The nature of the retained interest and the coal or mine of coal in which it subsists should be accurately described. If it is found necessary to refer to a map or other document it should be attached to the notice and signed by the person signing the notice so as to identify it.
(d)Date and signature of the person or body giving the notice or a person duly authorised by that person or body.

These Regulations prescribe the form of acceptance notice to be issued under paragraph 3(1)(a) of Schedule 7 to the Coal Industry Act 1994 whereby the person to whom a retained interest notice is given on or after the restructuring date, in response to an invitation under section 50(3)(d) of the 1994 Act or section 3(3)(b) of the Coal Industry Act 1975, accepts the title to a retained copyhold interest of the person giving the retained interest notice. (The form of acceptance notice for notices of retained interests given before the restructuring date, in response to invitations under section 3(3)(b) of the 1975 Act, continues to be that prescribed by S.I. 1976/478.)
