WEIGHTS AND MEASURES

The Weights and Measures (Metrication) (Miscellaneous Goods) (Amendment) Order 1994

6th November 1994

Coming into force in accordance with article 1

Whereas the Secretary of State, pursuant to section 86(2) of the Weights and Measures Act 1985(1), has consulted organisations appearing to him to be representative of interests substantially affected by this Order and has considered the representations made to him by such organisations with respect to the subject matter of this Order:

And whereas a draft of this Order has been laid before Parliament and approved by resolution of each House of Parliament pursuant to section 86(5) of that Act:

Now, therefore, the Secretary of State in exercise of the powers conferred on him by sections 22(1) and (2), 24(1) and 86(1) of that Act and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as the Weights and Measures (Metrication) (Miscellaneous Goods) (Amendment) Order 1994 and shall come into force on the day after the day on which it is made.

Amendments to be made in 1995

2. On 1st October 1995 the Orders specified in the Schedule to this Order shall be amended in the manner specified in that Schedule.

Article 2

SCHEDULEAMENDMENTS TO BE MADE IN 1995 TO ORDERS MADE UNDER THE WEIGHTS AND MEASURES ACT 1985

OrdersAmendments
The Weights and Measures (Intoxicating Liquor) Order 1988(2)

In article 1 in paragraph (2) after "Alcoholic Liquor Duties Act 1979" insert "but, in the case of "cider", as if the definition in section 1(6) did not include the words "(or perry)" in either place where they occur or "or pear"".

In article 5 in paragraph (1) for sub-�paragraph (a) substitute-

"(a)be pre-�packed only in one of the following quantities, that is to say, 25 cl, 50 cl, 75 cl or 1 L;".

The Weights and Measures (Miscellaneous Foods) Order 1988(3)

In article 4 in paragraph (1) omit the words after "indication of quantity by net weight".

In article 11 in paragraph (2) for "½ pt" substitute "250 ml".

In Schedule 1-

for the prescribed quantities specified in relation to coffee, coffee mixtures and coffee bags, substitute-

"57 g, 75 g, 113 g, 125 g, 227 g, 250 g, 340 g, 454 g, 500 g, 680 g, 750 g or a multiple of 454 g or of 500 g.",

for the prescribed quantities specified in relation to honey, jam and marmalade other than diabetic jam or marmalade, jelly preserves and molasses, syrup and treacle, substitute, in each case-

"57 g, 113 g, 227 g, 340 g, 454 g, 680 g or a multiple of 454 g.",

for the entry relating to milk, substitute-

"Milk other than milk in a returnable container

189 ml, 200 ml,

250 ml, 284 ml,

500 ml, 750 ml or

a multiple of

284 ml or of 500 ml.

50 ml or less--
Milk in a returnable container(1) ⅓ pt, ½ pt, or a multiple of ½ pt.50 ml or less--
(2) 200 ml, 250 ml, 500 ml, 750 ml or a multiple of 500 ml.50 ml or less--

and

for the prescribed quantities specified in relation to potatoes, substitute-

"500 g, 750 g, 1 kg, 1.5 kg, 2 kg, 2.5 kg or a multiple of 2.5 kg up to and including 15 kg, 20 kg or 25 kg."."

Explanatory Note

(This note is not part of the Order)

This Order implements amendments made by Council Directive 89/617/EEC (OJ No. L357, 7.12.89, p.28) to Council Directive 80/181/EEC (OJ No. L39, 15.2.80, p.40) ("the Directive") which relates to the use of units of measurement for economic, public health, public safety or administrative purposes ("the specified circumstances").

It amends the Weights and Measures (Intoxicating Liquor) Order 1988 "the Intoxicating Liquor Order") and the Weights and Measures (Miscellaneous Foods) Order 1988 ("the Miscellaneous Foods Order"). One amendment made to the Intoxicating Liquor Order provides that the requirement for beer, cider and perry to be sold only in quantities of ½ pint, ½ pint or multiples of ½ pint will no longer apply to perry to which the derogation for the pint in the Directive does not apply.

The amendments made to the Miscellaneous Foods Order include the conversion of the imperial prescribed quantities for pre-�packed coffee, honey, jam, marmalade, milk and potatoes to metric quantities. Milk in a returnable bottle may however still be pre-� packed by reference to the pint.
