The Merchant Shipping (Salvage and Pollution) Act 1994 (Commencement No. 2) Order 1994

The Secretary of State for Transport, in exercise of the powers conferred on him by section 10(4) of the Merchant Shipping (Salvage and Pollution) Act 1994(1), hereby makes the following Order:-�

1. This Order may be cited as the Merchant Shipping (Salvage and Pollution) Act 1994 (Commencement No. 2) Order 1994.

2. The provisions of the Merchant Shipping (Salvage and Pollution) Act 1994 specified in the first column of the Schedule to this Order (which relate to the matters specified in the second column of that Schedule) shall come into force on 1st January 1995.

SCHEDULEPROVISIONS COMING INTO FORCE ON 1ST JANUARY 1995

Provision of Merchant Shipping (Salvage and Pollution) Act 1994Subject matter
Section 1.Salvage Convention, 1989 to have force of law.
Section 2.Power to implement 1990 OPRC Convention.
Section 4.Prevention of pollution from ships: further power to implement international agreements.
Section 10, subsection (3), so far as it relates to the repeals in Schedule 4 specified below.Repeals.
Schedule 1.International Convention on Salvage, 1989.
Schedule 2.Salvage: Consequential and Related Amendments.

In Schedule 4, the repeals in:

Merchant Shipping Act 1894(2);

Maritime Conventions Act 1911(3);

Crown Proceedings Act 1947(4);

Merchant Shipping (Safety Convention) Act 1949(5);

Administration of Justice Act 1956(6);

Merchant Shipping Act 1988(7), except the repeal of paragraph 12 Schedule 4;

Merchant Shipping (Registration, etc.) Act 1993(8), except the repeal of paragraph 18 Schedule 4.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 1st January 1995 further provisions of the Merchant Shipping (Salvage and Pollution) Act 1994.

In particular it brings into force provisions giving the Salvage Convention, 1989, the force of law in the United Kingdom together with consequential provisions. (The Convention, although ratified by the United Kingdom, is not yet in force internation-� ally). The Order also makes possible the implementation of the International Convention on Oil Pollution Preparedness, Response and Co-�operation, 1990, and of provisions of the United Nations Convention on the Law of the Sea 1982, relating to the protection and preservation of the marine environment from pollution by ships.
