The Secretary of State in exercise of the powers conferred on him by section 33 of the Police Act 1964(1), after taking into consideration the recommendations made by the Police Negotiating Board for the United Kingdom and furnishing the said Board with a draft of the Regulations in accordance with section 2(1) of the Police Negotiating Board Act 1980(2), hereby makes the following Regulations:

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the Police (Amendment) (No. 4) Regulations 1994 and shall come into force on 21st December 1994, but shall have effect as from 1st September 1994.

(2) In these Regulations "the principal Regulations" means the Police Regulations 1987(3).

Determination of pay

2.-(1) Paragraph 1(1G) of Schedule 5 to the principal Regulations (pay points for constables) is amended by inserting below the item relating to pay category B-

(a)in the first column (pay category), "P";

(b)in the second column (pay point), "1(P)"; and

(c)in the third column (amount), "16,044".

(2) Paragraph 1(1H) of Schedule 5 to the principal Regulations (pay categories for constables) is amended-

(a)in the descriptions of categories A and B, by inserting after the words "31st August 1994" the words ", is not a protected member,"; and

(b)by inserting below the item relating to category B-

(i)in the first column category, "P", and

(ii)in the second column (description)-

(3) Paragraph 1(1I) of Schedule 5 to the principal Regulations (which defines expressions used in paragraph 1) is amended by inserting after the words "on probation" the words ", and references to a protected member are to a member who was appointed after 31st August 1994 but before 30th September 1994 and was of the age of 22 years or over on appointment".

Explanatory Note

(This note is not part of the Regulations)

The Police (Amendment) (No.3) Regulations 1994 (S.I. 1994/2331) introduced new pay arrangements for members of police forces. Those Regulations ("the No.3 Regulations") came into force on 30th September but had effect as from 1st September.

For constables joining the police at 22 years old or older, the rate of pay before 1st September was £16,044. Under the new arrangements the rate for new constables, irrespective of age, is £13,992. Constables joining at age 22 or over after 31st August but before 30th September would thus have received less than they would have done if the No.3 Regulations had not had retrospective effect. Section 33(4) of the Police Act 1964 allows retrospection but is not to "be construed as authorising pay or allowances payable to any person to be reduced retrospectively". Since the No.3 Regulations would have had that effect for constables in this category, these further amending Regulations are necessary to restore their entitlement to an initial rate of £16,044.
