The Firearms (Scotland) Amendment Rules 1994

Made

Coming into force

1st January 1995

The Secretary of State, in exercise of the powers conferred on him by sections 27(2) and (3), 53(a) and 57(4) of the Firearms Act 1968(1) and of all other powers enabling him that behalf, hereby makes the following Rules:

Citation, commencement, extent and interpretation

1.-(1) These Rules may be cited as the Firearms (Scotland) Amendment Rules 1994 and shall come into force on 1st January 1995.

(2) These Rules extend to Scotland only.

(3) In these Rules, "the 1989 Rules" means the Firearms (Scotland) Rules 1989(2).

Amendment of the 1989 Rules

2. In the prescribed form of firearm certificate set out in Part II of Schedule 1 to the 1989 Rules, for the word "three" wherever it occurs, there shall be substituted the word "five".

Application

3. These Rules shall apply only in respect of a firearm certificate granted or renewed on or after 1st January 1995.

Fraser of Carmyllie

Minister of State, Scottish Office

St Andrew's House,

Edinburgh

12th December 1994

Explanatory Note

(This note is not part of the Rules)

These Rules amend the form of firearm certificate prescribed by the Firearms (Scotland) Rules 1989 by substituting five years for three years in the references to the period for which the certificate is granted or renewed, as the case may be. This is a consequence of the period laid down in section 26(3) of the Firearms Act 1968 being so extended by the Firearms (Period of Certificate) Order 1994 (S.I. 1994/2614).

(1)

1968 c. 27; section 27(2) was amended by the Firearms (Amendment) Act 1988 (c. 45), section 23(5); section 53 was extended by section 25(6) of the 1988 Act; section 57(4) contains a definition of "prescribed".

(2)

S.I. 1989/889, amended by S.I. 1992/2821.
