The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by section 90(1) and section 124(3) of the Patents Act 1977(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the Patents (Convention Countries) Order 1994 and shall come into force on 13th January 1995.

2. The countries specified in Schedule 1 to this Order are convention countries for the purposes of section 5 of the Patents Act 1977.

3. Insofar as they have effect in relation to patents the Orders specified in Schedule 2 to this Order are hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order, pursuant to section 90(1) of the Patents Act 1977, declares the countries specified in Schedue 1 to be convention countries for the purposes of section 5 of the Patents Act 1977. The majority of countries specified in this Order have acceded to the International Convention for the Protection of Industrial Property ("the Paris Convention") (as revised at Stockholm in 1967) (Cmnd. 4431). Most of them have been declared to be convention countries pursuant to 67 separate orders, the earliest of which was made in 1901 and the last in 1993. All these orders, so far as they have effect in relation to patents, are made or treated as having been made under section 90(1) of the Patents Act 1977 for the purposes of section 5 of that Act. This Order revokes the orders making the earlier declarations in respect of patents and brings together all declarations in respect of such countries for the purposes of section 5 of the Patents Act 1977 into one instrument.

Included in the Order are also the following countries which have acceded as such to the Paris Convention since the last order (S.I.1993/1258) was made: Armenia, Bosnia and Herzegovina, Bolivia, El Salvador, Estonia, Georgia, Guyana, Honduras, Kyrgyzstan, Latvia, Liberia, Lithuania, the Former Yugoslav Republic of Macedonia, Moldova, Paraguay, Tajikistan and Uzbekistan.
