The Secretary of State for Transport, in exercise of the powers conferred by section 60 of the Public Passenger Vehicles Act 1981(1) ("the 1981 Act") and sections 6(9)(a) and 134(1) of the Transport Act 1985(2) and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 61(2) of the 1981 Act, hereby makes the following Regulations:-
1. These Regulations may be cited as the Public Service Vehicles (Registration of Local Services) (Amendment) Regulations 1994 and shall come into force on 1st February 1995.
2.-(1) Regulation 9 of the Public Service Vehicles (Registration of Local Services) Regulations 1986(3) shall be amended as follows.
(2) In paragrah (2)(g), after the word "may", there shall be inserted ", if the condition set out in paragraph (2A) is satisfied,".
(3) The following paragraph shall be inserted after paragraph (2)-
"(2A) The condition referred to in paragraph (2)(g) is that the operator of the service has reasonable grounds to expect that, owing to special circumstances, the number of vehicles normally required to provide the service would, at the time the additional vehicles are to be provided, be insufficient to carry all persons wishing to travel on the service or to provide the service in accordance with the registered timetable, unless the additional vehicles were provided."

These Regulations amend the Public Service Vehicles (Registration of Local Services) Regulations 1986 so as to limit the circumstances in which a local bus service registered under the Transport Act 1985 can be varied by the running of duplicate buses, without the registration being varied.
