The Secretary of State for Transport, in exercise of the powers conferred by section 11 of the Channel Tunnel Act 1987(1), and of all other powers enabling him in that behalf, hereby makes the following Order:-
1. This Order may be cited as the Channel Tunnel (Sunday Trading Act 1994) (Disapplication) Order 1994 and shall come into force on 19th January 1995.
2. In this Order:
"the deposited plan" means the plan marked "The Channel Tunnel (Sunday Trading Act 1994) (Disapplication) Order 1994", signed by authority of the Secretary of State for Transport, dated 22nd November 1994 and deposited at the Department of Transport, Parliamentary Library, Room P3/001, 2 Marsham Street, London SW1P 3EB, and
"large shop" has the same meaning as in the Sunday Trading Act 1994(2).
3. Paragraph 2(1) of Schedule 1 to the Sunday Trading Act 1994 shall not apply to any large shop situated in that part of the terminal area of the tunnel system located at the portals of the tunnels in the vicinity of Cheriton, Folkestone, that is within the area shown coloured blue on the deposited plan.

(This note is not part of the Order)
This Order excludes the application of paragraph 2(1) of Schedule 1 to the Sunday Trading Act 1994, which provides that (subject to certain exceptions) a large shop shall not be open on Sunday for the serving of retail customers, in relation to any shops situated in a specified part of the terminal area of the Channel Tunnel system at Cheriton (article 3).
The deposited plan referred to in article 4 can be seen between 10.00 and 16.00 hours at the Department of Transport at the address given in article 2 of the Order as well as at the Eurotunnel Customer Service Centre at Cheriton Parc, St. Martin's Plain, Cheriton, Folkestone, where a certified duplicate is deposited and can be inspected during normal office hours.
