The Secretary of State for the Environment, as respects England, the Secretary of State for Wales, as respects Wales, the Secretary of State for Scotland, as respects Scotland, and the Secretary of State for Northern Ireland, as respects Northern Ireland, in exercise of the powers conferred on them by section 2(2) of the European Communities Act 1972(1), being the Ministers designated(2) for the purposes of that section in relation to the control of air pollution, and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement, extent and interpretation

1.-(1) These Regulations may be cited as the Ozone Monitoring and Information Regulations 1994 and shall come into force on 21st March 1994.

(2) These Regulations extend to the United Kingdom.

(3) In these Regulations "the Directive" means Council Directive 92/72/EEC on air pollution by ozone(3).

Measuring stations

2.-(1) The Secretary of State shall where appropriate designate or establish measuring stations to supply the data necessary for the implementation of the Directive.

(2) The number and location of these stations shall be determined by the Secretary of State in compliance with Annex II to the Directive.

Measurement of ozone concentrations

3.-(1) In this regulation "the reference method" means the reference method specified in Annex V to the Directive.

(2) The Secretary of State shall ensure that, at the measuring stations designated or established in accordance with regulation 2 above, concentrations of ozone in the ambient air are measured using either-

(a)the reference method, or

(b)any other method of analysis shown to produce measurement results equivalent to those obtained using the reference method.

(3) The Secetary of State shall designate one or more laboratories to be responsible for evaluating, in relation to the reference method, the methods of analysis used in the United Kingdom.

(4) The Secretary of State shall organise, at national level, intercomparisons between laboratories taking part in the collection and analysis of the data obtained from carrying out the measurements referred to in paragraph (2) above.

Informing the public if ozone concentration values are exceeded

4. In the event of the values given in points 3 and 4 of Annex I to the Directive being exceeded, the Secretary of State shall take the necessary steps for the public to be informed in accordance with Article 5 of, and Annex IV to, the Directive.

Explanatory Note

(This note is not part of the Regulations)

These Regulations implement, in the United Kingdom, Council Directive 92/72/EEC on air pollution by ozone.

Regulation 2 requires the Secretary of State to designate or establish measuring stations for monitoring ozone concentrations and regulation 3 provides for the method to be used for measuring those concentrations.

Regulation 4 requires the Secretary of State to take the necessary steps to inform the public in the event of certain ozone concentration thresholds being exceeded.
