The Railways (Alternative Closure Procedure) Order 1994

The Secretary of State, in exercise of the powers conferred on him by sections 49(3) and 143(4) of the Railways Act 1993(1), and of all other powers enabling him in that behalf, hereby makes the following Order:-

1. This Order may be cited as the Railways (Alternative Closure Procedure) Order 1994 and shall come into force on 1st April 1994.

2. The railway passenger services provided or operated under or by virtue of the enactments referred to in the Schedule to this Order (being services in relation to which section 37 (proposals to discontinue non-franchised etc passenger services) of the Railways Act 1993 does not have effect by virtue of

(i)article 6 of the Railways (London Regional Transport) (Exemptions) Order 1994(2), and

(ii)article 7 of the Railways (Class and Miscellaneous Exemptions) Order 1994(3)) are services in relation to which the provisions of Schedule 5 (alternative closure procedure) of the Railways Act 1993 are to have effect.

Explanatory Note

(This note is not part of the Order)

This Order designates the railway passenger services in relation to which Schedule 5 of the Railways Act 1993 is to have effect. Schedule 5 contains provisions relating to the discontinuance of railway passenger services.
