The Social Security (Recoupment) (Prolongation of Period for Furnishing of Certificate of Total Benefit) Order 1995

The Secretary of State for Social Security, in exercise of the power conferred upon him by section 96(4) of the Social Security Administration Act 1992(1), and of all other powers enabling him in that behalf, being of the opinion that circumstances have arisen which adversely affect normal methods of communication, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Social Security (Recoupment) (Prolongation of Period for Furnishing of Certificate of Total Benefit) Order 1995 and shall come into force on 27th April 1995.

Prolongation of Period for Furnishing of Certificate of Total Benefit for the Purposes of Determining whether Liability has Ceased to be Enforceable

2. No liability of a compensator under section 82 of the Social Security Administration Act 1992 shall become unenforceable by virtue of section 96(1)(c) of that Act during a period of three months commencing on the date this Order comes into force.

Explanatory Note

(This note is not part of the Order)

This Order provides that, for the time limit designated in section 96(1)(c) of the Social Security Administration Act 1992 for the furnishing of a certificate of total benefit, namely that referred to in section 95(1) of that Act, there shall be substituted a period of three months commencing on the date this Order comes into force.

This Order does not impose any costs on business.
