The Secretary of State for Transport makes this Instrument in exercise of powers conferred by sections 106(3) and 108(4) of the Highways Act 1980(1) and now vested in him(2) and of all other powers enabling him in that behalf:

1. The Lincolnshire County Council (B1003/A57 Rope Walk to Carholme Road Link, Lincoln, Fossdyke Navigation and Brayford Pool Bridge) Scheme 1995 is hereby confirmed without modifications.

2. The said Scheme as confirmed (hereinafter referred to as "the Scheme ") is set out in the Schedule hereto and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, Romney House, 43 Marsham Street, London SW1 3PY and at the offices of Lincolnshire County Council, County Offices, Newland, Lincoln LN1 1YP and its Department of Highways and Planning, City Hall, Beaumont Fee, Lincoln.

3. The Scheme will become operative on the date on which the notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4. This Instrument may be cited as The Lincolnshire County Council (B1003/A57 Rope Walk to Carholme Road Link, Lincoln, Fossdyke Navigation and Brayford Pool Bridge) Scheme 1995 Confirmation Instrument 1995.

THE SCHEDULETHE LINCOLNSHIRE COUNTY COUNCIL (B1003/A57 ROPE WALK TO CARHOLME ROAD LINK, LINCOLN, FOSSDYKE NAVIGATION AND BRAYFORD POOL BRIDGE) SCHEME 1995

The Lincolnshire County Council (hereinafter referred to as "the County Council ") make this scheme in exercise of their powers under Sections 106(3) and 108(4) of the Highways Act 1980 and of all powers enabling them in that behalf:-

1. The County Council are authorised to construct over the navigable waters of the Fossdyke Navigation and Brayford Pool the bridge specified in the Schedule to this Scheme as part of the highway which they are proposing to construct from a point on theRope Walk (B1003) 140 metres north east of its junction with Beevor Street and 470 metres south of the southern bank of the Fossdyke Navigation to a point on Carholme Road (A57) at its junction with Brayford Wharf North 60 metres north of the northern bank of the Brayford Pool in the City of Lincoln in the County of Lincoln.

2. he County Council are also authorised in connection with the construction of the said bridge to divert part of the navigable waters of the Fossdyke Navigation and Brayford Pool specified in the said Schedule in the manner shown in that Schedule.

3. This Scheme may be cited as the Lincolnshire County Council (B1003/A57 Rope Walk to Carholme Road Link, Lincoln, Fossdyke Navigation and Brayford Pool Bridge) Scheme 1995.

GIVEN under the Common Seal of the Lincolnshire County Council the Thirtieth day of January 1995.

THE SCHEDULE TO THE SCHEMEPLANS AND SPECIFICATIONS OF THE BRIDGE OVER THE FOSSDYKE NAVIGATION

The site and general design of the bridge, and of the diversion of the navigable waters of the Fossdyke Navigation and Brayford Pool, are shown on the plan numbered B/N1613/BSA1 annexed hereto.

POINTS OF COMMENCEMENT AND TERMINATION

Commencing from a point on the north bank of the Fossdyke Navigation/Brayford Pool 11.5 metres north east of the existing drawbridge, Map reference 494960 east 371330 north.

Terminating at a point on the south bank of the Fossdyke Navigation/Brayford Pool 64.5 metres south west of the existing drawbridge, Map reference 496890 east 371280 north.

All on Ordnance Sheet SK9671 (1993).

OVERALL DIMENSIONS

The bridge will be 18.4 metres wide overall and will carry a 10 metre wide carriageway with 3.6 metre wide footways on both sides. It will have an overall length of 83.7 metres measured along the centre line of the road.

NAVIGATION SPAN

The bridge consists of three spans; of which the northern span of 36.2 metres crosses over Public Footpath No. 27, the Fossdyke Navigation, Brayford Pool and the new cycle track. All distances measured along the centre line of the road

HEADWAY

4.7 metres minimum above normal retention level which is 4.4 metres above Ordnance Datum (Newlyn) provided under the span, immediately north of the south bank of the Fossdyke Navigation.

WATERWAY

Waterway, minimum width 13 metres measured square to the canal, provided under the span immediately north of the south bank of the Fossdyke Navigation.

LENGTH OF WATERCOURSE TO BE DIVERTED AND PARTICULARS OF DIVERSION OF WATERCOURSE

From the western edge of the existing drawbridge, a width of 11 metres northwards from the southern edge of the Fossdyke Navigation, for a distance of 34 metres eastwards, tapering, to rejoin the existing navigable channel 25 metres east of the drawbridge and 8 metres north of the southern bank of the Brayford Pool.

The existing depth of water within the existing navigable channel will be provided throughout the diverted channel.
