The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in relation to England and Wales, and the Secretary of State for Scotland in relation to Scotland, in exercise of the powers conferred on them by sections 16(1)(a), (c) and (e) and 17(1) of the Food Safety Act 1990(1) and of all other powers enabling them in that behalf, after consultation in accordance with section 48 of that Act with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations, hereby make the following Regulations:-
1. These Regulations may be cited as the Fruit Juices and Fruit Nectars (England, Wales and Scotland) (Amendment) Regulations 1995 and shall come into force on 1st March 1995.
2. In these Regulations "the principal Regulations" means the Fruit Juices and Fruit Nectars Regulations 1977(2) and the Fruit Juices and Fruit Nectars (Scotland) Regulations 1977(3).
3. In the definition of "fruit nectar" in regulation 2(1) of the principal Regulations there shall be inserted after sub-paragraph (d), the following sub-paragraph-
"(e)where the naturally high sugar content of apricots, any fruit specified at item 2 or 3 of column 1 of Schedule 1 or any admixture thereof so warrants, they may be used to manufacture the product without the addition of sugar or honey;".

These Regulations amend the Fruit Juices and Fruit Nectars Regulations 1977 and the Fruit Juices and Fruit Nectars (Scotland) Regulations 1977 ("the principal Regulations") to implement Commission Directive 93/45/EEC concerning the manufacture of nectars without the addition of sugars or honey (OJ No. L159, 1.7.93, p.133).
Regulation 3 amends the definition of "fruit nectar" in regulation 2(1) of the principal Regulations. The effect of this amendment is to allow fruit nectar to be manufactured using apricots, other specified fruit or any admixture thereof without the addition of sugar or honey, where the naturally high sugar content of such fruit so warrants.
