The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purpose of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to Community plant variety rights, acting jointly, in exercise of the powers conferred on them by the said section 2(2), hereby make the following Regulations:
1.-(1) These Regulations may be cited as the Plant Variety Rights Office (Extension of Functions) Regulations 1995 and shall come into force on 1st November 1995.
(2) In these Regulations -
"Community Office"means the Community Plant Variety Office established by Council Regulation (EC) No. 2100/94;(3)
"National Office"means the Plant Variety Rights Office established by section 11 of the Plant Varieties and Seeds Act 1964.(4)
2. The National Office shall have power to carry out such functions as may be entrusted to it by the Community Office in accordance with Articles 30(4) and 55(1) of Council Regulation (EC) No. 2100/94.

These Regulations enable the United Kingdom Plant Variety Rights Office to carry out functions entrusted to it by the Community Plant Variety Office, created by Council Regulation (EC) No. 2100/94. These functions are the exercise of specific administrative functions of the Community Office and the technical examination of varieties relating to compliance with the qualifying criteria for protection under the Community scheme.
