CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (England) (Partial Revocation) Order 1995

Whereas the Minister of Agriculture, Fisheries and Food was of the opinion, in accordance with section 1(1)(a) of the Food and Environment Protection Act 1985(1), that there had been or might have been circumstances as were likely to create a hazard to human health through human consumption of food;

And whereas the said Minister was of the opinion, in accordance with section 1(1)(b) of the said Act, that in consequence of the said circumstances food which was or might have been in the future derived from sheep in the area described in Schedule 1 to the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (England) Order 1991(2) was, or might have been, or might have become, unsuitable for human consumption;

And whereas the said Minister is now of the opinion that food which is derived or may in the future be derived from sheep in the areas described in Part I of the Schedule to this Order is no longer unsuitable for human consumption in consequence of the said circumstances;

Now, therefore, the said Minister, in exercise of the powers conferred on him by section 1(1), and (2) and section 24(1) and (3) of the said Act, and of all other powers enabling him in that behalf, hereby makes the following Order:

Title and commencement

1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (England) (Partial Revocation) Order 1995 and shall come into force on 18th January 1995.

Partial Revocation

2.-(1) The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (England) (Order) 1991(2) is hereby revoked so far as it designates any part of the areas set out in Part I of the Schedule to this Order.

(2) In consequence of that revocation the designated areas for the purposes of that Order are those areas set out in Part II of the Schedule to this Order.

Explanatory Note

(This note is not part of the Order)

This Order further partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (England) Order 1991 which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been or may have been rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.

This partial revocation reduces the areas subject to the restrictions set out in the principal Order. The last partial revocation was contained in the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (England) (Partial Revocation) Order 1994 (Statutory Instrument 1994 No. 65).
