The Secretary of State for Health, in exercise of powers conferred on her by sections 15(1)(b) and 126(4) of the National Health Service Act 1977(1) and of all other powers enabling her in that behalf, hereby makes the following Regulations:-

Citation, commencement and interpretation

1.-(1) These Regulations may be cited as the National Health Service (Functions of Family Health Services Authorities) (Prescribing Incentive Schemes) Regulations 1995 and shall come into force on 1st April 1995.

(2) In regulation 2-

"the Act" means the National Health Service Act 1977;

"directions" means directions given by the Secretary of State under section 17 of the Act;

"FHSA" means Family Health Services Authority;

"practice" means one with respect to which section 18(1) of the National Health Service and Community Care Act 1990(2) Act applies;

"prescribing incentive scheme" means a scheme under which an FHSA is required to make a payment to a practice which, in any financial year, has contained its prescribing costs as specified in directions.

Prescribed function of Family Health Services Authorities

2. For the purposes of section 15(1)(b) of the Act it shall be a prescribed function of each FHSA to establish, operate and make payments to practices under a prescribing incentive scheme in accordance with directions.

Explanatory Note

(This note is not part of the Regulations)

These regulations confer a new statutory function on Family Health Services Authorities (FHSAs). The new function is to establish and operate schemes, in accordance with directions made by the Secretary of State, under which FHSAs make payments to GP practices in their localities which contain their prescribing costs.
